This thesis contains three chapters: the first one develops the phylogenesis of institutions, such as the principle of publicity, rule of law, right of access to public information, information secrecy and democracy. The second focuses on reviewing the justification and criticism of the reservation of defense and national security information in projection of the national interest. The third one proposes an examination of the reservation of public information on defense and national security from the perspective of constitutional jurisprudence. Thus, it is necessary to make a judgment and analysis of the reservation of information, which must start from a study of the exercise of the competence to restrict the information, in order to subsequently determine how valid are the reasons and justifications to restrict the information in a rule of law that should be characterized as democratic, and not only for invoking national interests of survival.Ítem La responsabilidad civil de las entidades financieras derivada de la terminación unilateral de los contratos bancarios a las empresas del sector minero(Universidad EAFIT, 2023) Pérez Henao, Julián Mauricio; Baena Aramburo, FelisaÍtem Inhabilidades electorales para cargos de elección popular(Universidad EAFIT, 2023) Saldarriaga Gutiérrez, Samuel; Gómez Velásquez, AlejandroThis research project aims to make a contribution from legal dogmatics regarding the concept of electoral disqualifications in Colombia. To achieve this, it was necessary to investigate the history and theoretical framework of disqualifications and political rights. It is crucial to understand that these types of rights have different limitations on their exercise. For example, legal concepts like disqualifications condition and impose restrictions on those who seek to be elected by popular vote. Within this context, the fundamental principles accompanying the democratic rule of law were explained, such as the separation of powers, the principle of legality, and the democratic principle. These principles are essential to ensure the imposition of limits on power, the stability of political rights, and the establishment of electoral disqualifications. Additionally, this text contains an analysis of the purpose of disqualifications and the need for their existence to ensure the stability of the State, the prevalence of the general interest, and the requirement that individuals occupying positions of popular election be morally accepted and possess high standards of suitability and integrity for the exercise of public office. Furthermore, this research project presents arguments regarding the way in which disqualifications are prescribed in Colombian territory, explaining each electoral disqualification cause, both common and specific, as prescribed in the Political Constitution and the different laws containing disqualifications for those aspiring to be mayors, governors, councilors, deputies, and congressmen. Finally, to complement the research and gain a clearer understanding of how disqualifications are structured in Colombia, it was necessary to study the powers of judicial authorities to protect political rights through procedures such as loss of investiture or electoral nullity. All of this with the aim of determining if the programs and/or public policies on public space that are included in the current Accords of Medellín have allowed the enjoyment of the “right to the city”.Ítem El restablecimiento del equilibrio económico en los contratos de entidades públicas con régimen exceptuado de contratación en Colombia(Universidad EAFIT, 2023) Restrepo Ramírez, Juan Diego; Díaz Díez, Cristian AndrésThe binary conception of contractual regimes in Colombia —understood as the application of the private regime by some state entities and the General Statute of Public Administration Contracting (Law 80 of 1993) by others has generated practical difficulties in its implementation, due to the state nature of the entities that apply the private regime, since it does not regulate all the obligations or duties that state entities must meet or its application could be incompatible with the public purposes pursued with state contracting. One of these institutions corresponds to the economic balance of the contract, which is one of the problems widely discussed in court and, therefore, of great illustrative relevance to demonstrate the complexity of the duality of contractual regimes in Colombia. Despite the importance of the country in the clinical research scenario, there is little regulation that, at the national level, deals with the possible adverse consequences of this activity and the applicable liability regime. This article aims, first of all, to briefly outline the main characteristics of clinical trials, focusing on those that involve the application of molecules or drugs and highlighting the actors who take part in said trials. Subsequently,; Colombian regulations will be critically examined, specifically those referring to liability for damages derived from clinical trials; and a contrast will be made with the regulation of some countries in this matter.
