This text presents an analysis of the BEPS system in Colombia as a pension savings option and its role within the pension system. The methodology employed involves projecting the BEPS system in various scenarios, observing its evolution since its inception, and considering the proportion of informality. The study also delves into the key features of the BEPS program and its significance in the context of pension reform. The motivation behind this work is to assess the importance of BEPS within the Colombian pension system, particularly in light of a potential pension system reform.
Análisis de la evolución normativa y jurisprudencial del reconocimiento de la pensión de invalidez en Colombia para afiliados con insuficiencia de semanas cotizadas

The general objective of this research is to analyze the gaps in Colombian legislation on the disability pension of common origin and its impact on workers who require this benefit. Social security in Colombia seeks to guarantee the economic protection of people who, due to a disability, are affected by their ability to generate income. However, the current regulations present inconsistencies in terms of access requirements, the treatment of independent workers and the application of the principle of favorability in case law. This study addresses the legal evolution of the disability pension in Colombia, identifying the main barriers faced by applicants in practice. The most relevant judicial decisions are analyzed, including pronouncements of the Constitutional Court and the Supreme Court of Justice, in order to show how the interpretation of the regulations has influenced the recognition of this right. In addition, the contribution criteria, the structure of the pension system and the problems associated with the lack of uniformity in its application are compared. Finally, proposals are presented to improve the accessibility and equity of the system, ensuring that people with disabilities can access a fair pension appropriate to their conditions.

This undergraduate thesis examines the persistent gap between the judicial recognition of comprehensive health care and the effective access to gender-affirming medical services for trans persons in Colombia, within the framework of the General Health Social Security System. Despite the robust jurisprudence of the Constitutional Court protecting the rights to health, gender identity, and free development of personality, administrative barriers, discrimination, and the absence of unified medical protocols hinder the materialization of these rights. Through a case study of the “Griselda Giraldo” file, processed by the Legal Clinic of EAFIT University, this research identifies the reasons why judicial protection (constitutional protection action or 'tutela' action) often proves insufficient to ensure effective access to the necessary procedures. The study analyzes relevant case law, gender-affirming procedures and their connection with fundamental rights, as well as the problematic implications of this gap for the health and dignity of trans persons.

In 1990 article 15 of Law 50 amended The Colombian Substantive Labor Code on its article 128, opening the possibility to celebrate salary exclusion agreements in Colombia, stating that the parties could expressly agree that payments in money or in kind would not constitute wages. However, it wasn’t clear if this generated a benefit for the worker, or instead affected their rights, since there can be an evasion in the payment of social benefits and contributions to the Integral Social Security System. Therefore, through the construction of a jurisprudential line, taking into account what is established by law and pronouncements of the doctrine, it will be analyzed which are the limits and freedoms that are established to regulate non-constitutive salary payments, it will also be determined with the analysis the contradictions that have been presented over time between them.

The purpose of this project is to present a series of situations that are currently arising because of social changes and sexual identity. With this project we seek to analyze the recognition of sexual diversity in the Colombian regulations, and we will focus especially on the way in which social security operates and its correlative access to the rights and benefits that derive from it, applying it specifically to the case of transgender men who have made the decision to gestate. Our work will have a theoretical-legal research method, in which we will analyze the implications of the concepts and definitions of sexual categories in the Colombian normative level, based on the recent ruling of the Constitutional Court on the application of maternity license to non-binary persons and pregnant transgender men.

Efectos de la Ley 2381 de 2024 sobre el mínimo vital de cotizantes con más de 299 semanas

This monograph analyzes the legal loophole presented by Law 2381 of 2024, which, it should be noted, is currently under constitutional review. This law excludes contributors with more than 299 weeks of contributions who do not meet the requirements to access a pension and who, at the same time, lack mechanisms for the return of balances or substitute compensation. This study is based on the constitutional principles of the minimum subsistence level, human dignity, and the progressiveness of social rights, with a critical focus on the state's failure to guarantee the protection of the rights of the social welfare state for its members. A dogmatic and jurisprudential analysis is used, adhering to a comparative law exercise with Chile, Mexico, and Uruguay, countries that implement refunds of funds and non-contributory pensions for those who do not meet the full pension requirements. The research concludes that there are legal irregularities and contradictions of constitutional principles, and guidelines for reinterpretation and reform are proposed.

El riesgo de vejez en Colombia no fue siempre administrado por una entidad estatal, ni su costo asumido por el empleador y el trabajador -- En 1946 se creó el Instituto de Seguros Sociales, cuya finalidad era la de subrogar al empleador en la obligación frente al riesgo de vejez de los trabajadores mientras se realizaran los aportes correspondientes -- La cobertura del sistema en el territorio colombiano se hizo de manera progresiva, conduciendo a distintas fechas de llamamiento -- En 1993 con la expedición de la Ley 100, se efectuó el llamamiento total para todos los empleadores colombianos a afiliar a sus trabajadores -- Para los que ya hubiesen cumplido 20 años de labor y la edad requerida, la jubilación seguiría a cargo del empleador mientras que los que no habían cumplido los 20 años pero si más de 10 años de servicio, la pensión seria compartida entre el Instituto y el empleador, y finalmente para los trabajadores que llevaran menos de 10 años de servicios, la Ley 100 estableció que tenían derecho a que se les tuviera en cuenta el tiempo laborado; solo para quienes mantenían el contrato aún vigente cuando comenzó a regir esta ley -- Lo anterior conllevó a tomar varias posturas frente al dilema de qué sucede con los trabajadores que prestaron el servicio por menos de 10 años -- Una postura obliga al empleador mientras la otra lo absuelve de la obligación -- Con el presente trabajo se pretende dar la solución más sensata al dilema que recae sobre la obligación de los empleadores y los derechos de los trabajadores, a partir de un análisis normativo y jurisprudencial
¿En las pensiones reconocidas o reliquidadas por el Consejo de Estado a los servidores públicos beneficiarios del régimen de transición antes de la Sentencia 00143 de 2018, prima su precedente jurisprudencial frente a la cosa juzgada o es posible, modificar tales decisiones en virtud del recurso extraordinario de revisión, según la tesis de la Corte Constitucional?
