As a result, the insurance company usually imposes unfair terms on the insured, in detriment of his rights. However, the criteria for identifying unfair terms in the insurance agreement are not fully specified in our legal system. Therefore, it is of major importance for the insured to be aware of the requirements that make up such clauses. Consequently, this paper will identify the characteristics of unfair terms in the framework of the insurance contract in Colombia, based on an integrated analysis of the relevant laws, the jurisprudence of the Supreme Court of Justice and the national and foreign doctrine. Afterwards, a casuistic analysis will be carried out, which shall allow to put into practice, and thus reinforce, the previously analyzed theory.Ítem Análisis de pertinencia : modelo de implementación de blockchain en los contratos del sector público : el caso Corporación Gilberto Echeverri Mejía(Universidad EAFIT, 2023) Álvarez Zapata, Erika Joana; Blandón Vélez, Evénide del Socorro; Escalante Gómez, Juan EstebanThis degree work aims to analyze the relevance of the Blockchain implementation model in public sector contracts. For this purpose, a research with a qualitative approach, descriptive scope and non-experimental design is developed, which analyzes, through three (3) steps (1 - identification and mapping of the risks associated with contracts, 2 - analysis of Blockchain technology, 3 - evaluation through a model of the applicabilities of Blockchain for the organization) the suitability of this tool in the framework of state contracting. The results reveal that this type of entities are exposed to multiple phenomena that may affect their operation (legal, operational, technological, financial, compliance, security, political and social, and reputational aspects are highlighted). In addition, it is shown that the Blockchain constitutes a tool that contributes to improve the conditions of digitization, security, transparency and traceability of data. Since the creation of Bitcoin in 2009 and the consequent implementation of the Blockchain as an emerging technology based on chain approvals, multiple uses have been derived from it, whether for the creation of applications, efficiency in business models or processes, electronic payments, or the conclusion of smart contracts. However, the latter has been the object of analysis due to their particular importance and transcendence in how negotiations, agreements, pacts, or any relationship derive in a contract's conclusion. In this sense, from a legal perspective multiple challenges have been established regarding the regulation and adoption of smart contracts. So far, this topic continues to lack normativity due to the difficulty of the application of the current theory of legal business in relation to Smart Contracts. In the present investigation, a historical recount of some figures and/or elements that gave rise to the creation of the Smarts Contracts will be carried out. Therefore, a specific definition of concepts such as Bitcoin, Blockchain, and Ethereum, among others, will be made to understand the emergence of smart contracts and how they work. Likewise, the Smart Contract concept will be specified, and its usefulness and practical application will be determined. Additionally, a comparative study between these and traditional legal businesses will be carried out to observe, based on their legal nature, whether or not they meet the minimum requirements for a contract agreement to exist legally. On the other hand, this paper shall conduct a study of the current foreign regulations on Smart Contracts, in order to determine how they have been implemented within foreign legal systems. Likewise, the advantages and disadvantages that the implementation of this new contracting modality may bring will be identified. In 2021, they issued circular 20211700000004-5, instructing the creation of a comprehensive risk management system for IPS. Actuarial risk management is essential for valuing health contracts, as IPS face various risks in their operations. The circular urges IPS to perform stress tests and self-verification on actuarial models used to establish contractual values, adjusting them to mitigate risks. These models determine service premiums, and miscalculation could affect operations, generating budget deficits. Sufficiency studies and risk adjustments from the Ministry of Health will be used to calculate capitation payments in 2023. In particular, the problem related to the signing of a contract called BOOMT will be analyzed, which, in accordance with the public information disclosed by the Attorney General's Office, was maintained between two public entities, which, was also preceded by an inter-administrative agreement between two public entities that are partners in the mentioned project and also different legal entities from those that later signed the BOOMT. The narrated facts have led the Prosecutor's Office to consider that in this case, when the contract was signed as indicated, was committed the crime of signing a contract without compliance with essential legal requirements, contained in the article 410 of the Colombian crime code. In light of what was exposed above, we commit to carry out an analysis of the administrative laws that regulate public contracting and the domiciliary public service companies regime. From this regulatory rules compound, and based on the analysis of doctrine and jurisprudence, we will propose a deliberation to the problems of the criminal charges mentioned.Ítem Desafíos regulatorios de las plataformas digitales de transporte en Colombia en materia laboral : un análisis integral desde las diversas modalidades contractuales(Universidad EAFIT, 2024) Sánchez Cárdenas, María Catalina; Gómez Hernández, Wilmer Alexander; Aguirre Muñoz, Angélica María; Cortés Ramírez, Jairo DanielDespite the undeniable impact of digital transportation platforms in global economies, they are facing a regulatory dilemma due to the regulatory void and absence of clear rules that regulate the relationship between the two sides of the relationship (platform owners and transporters). This situation becomes especially evident in contexts such as the Colombian context, where so far there is no legal framework that specifically regulates such interactions. The reason for the above could be attributed to the fact that the transportation services offered through these platforms seem to escape the traditional categories of employment contract or personal service provision. This presents a considerable challenge when defining the type of relationship existing between the parties involved, a crucial aspect to determine which would be the conditions that guarantee the protection of the rights of these collaborators.
