    In complex organizational structures, such as public entities, those responsible for approving expenditures frequently delegate authority related to public procurement. Therefore, the objective of this study is to determine in what circumstances the legal representative of a public entity can be held liable for actions that they did not personally carry out, but for which they are legally responsible due to their position of authority, particularly in cases of entering into contracts without complying with legal requirements and embezzlement. Additionally, this study aims to determine how the principle of reliance can serve as a defense against criminal liability in activities conducted by a team. Les gestionnaires de dépenses au sein de structures organisationnelles complexes, telles que les entités publiques, ont fréquemment recours à la délégation en matière de marchés publics. Par conséquent, l'objectif de cette étude est de déterminer dans quels cas le représentant légal d'une entité publique peut être tenu responsable d'actes qu'il n'a pas matériellement exécutés, mais qui lui sont légalement imputables en raison de sa qualité de garant, notamment en cas de conclusion de contrat non conforme aux exigences légales et de détournement de fonds. Elle vise également à déterminer comment le principe de confiance est appliqué comme exonération de responsabilité pénale dans les activités menées par une équipe.

    Análisis del artículo 19 de la ley 2466 de 2025 e implicaciones de su aplicación retroactiva

    This thesis examines the interpretation of Article 19 of Law 2466 of 2025 and its implications for Colombian criminal law, particularly regarding the penitentiary policy of sentence redemption as a mechanism of resocialization (Colombia, Congreso de la República, 2025, art. 19). The provision not only serves as a tool to shorten periods of incarceration but also represents an effective means of safeguarding fundamental rights of persons deprived of liberty, such as human dignity, equality, due process, and the resocializing function of punishment. The potential retroactive application of this article, based on the principle of favorability, could generate a significant legal and social impact by reducing prison overcrowding and improving reintegration conditions. Considering the Constitutional Court’s recognition of an unconstitutional situation in the prison system, this study argues for an interpretation that enhances fundamental rights protection and contributes to the humanization of the penitentiary system.

    El peligro futuro en el derecho penal colombiano, implicaciones para la libertad del imputado, reflexiones sobre su aplicación

    The present investigation focuses on critically analyzing the legal figure of Future Danger within the framework of Colombian Criminal Law. During the investigation, the implications of a specific legal figure that could compromise the freedom of the accused were thoroughly examined and during this analysis, it was arrived at. to the conclusion that the application of this principle could have serious repercussions, not only in terms of undermining the freedom of the individual under legal scrutiny, but also from a constitutional perspective and international human rights standards. In the course of this investigation, the inadequacy of the implementation of this principle was highlighted and it was argued that this principle clashes head-on with the fundamental and constitutional concept of the presumption of innocence, which is a cornerstone of modern legal systems, in addition , it was observed that this legal figure comes into direct conflict with the Constitutional Block, which is made up of International Treaties ratified by Colombia, which have been incorporated into the legal structure of the country after being reviewed and approved by both the Congress of the Republic and by the Constitutional Court, and therefore have binding force. It is imperative to highlight that this principle can seriously undermine the very foundations of a fair and equitable judicial system. Likewise, the results of the investigation ended up highlighting that its implementation could lead to violations of fundamental rights and move away from respect for dignity. human rights enshrined both in the 1991 Constitution and in the International Human Rights Covenants signed by Colombia. Therefore, the main conclusion of this study is the strong and direct recommendation not to implement this principle, given its inconsistency with entrenched Constitutional Principles and its potential negative consequences on the integrity and respect of individual rights within the context of the Law.     El uso de psicodélicos en Colombia para prácticas psicoterapéuticas experimentales : normativa aplicable y análisis dogmático del riesgo desaprobado

    This study explores the legal and criminal risks associated with the therapeutic use of psychoactive substances in Colombia, particularly in the context of experimental psychotherapy with psychedelics. Using the theory of objective imputation, which identifies legally disapproved risks in crimes of mere activity, the research evaluates whether these experimental therapeutic practices fall within the bounds of permitted risk. Through a normative and penal analysis, the study examines the criteria for determining when such practices pose a significant threat to legally protected interests and under what conditions this risk can be justified or considered irrelevant from a criminal law perspective.

    Enfoque de género en casos de violencia intrafamiliar : revisión de ciertas decisiones importantes del Tribunal Superior de Medellín en 2024

    This paper critically analyzes the role of the Superior Court of Medellín in domestic violence proceedings during 2024, with special emphasis on the incorporation of a gender perspective in judicial decisions. The study, focused exclusively on Medellín and its metropolitan area, combines the review of rulings issued by the criminal, labor, and family chambers with local statistics, institutional reports, and oversight body findings. The results show that, within the criminal jurisdiction, although domestic violence was proven in all cases, the gender-based aggravating factor under Article 229 of the Colombian Criminal Code was systematically dismissed, contributing to scenarios of impunity and limiting the judicial recognition of structural violence against women. In contrast, the labor and family chambers adopted a more rights-protective approach, easing evidentiary requirements and applying international standards such as the Belém do Pará Convention, in order to prevent revictimization and protect individuals in vulnerable situations. In conclusion, the research reveals that in Medellín there remains a tension between procedural rigor and the State’s obligation to provide reinforced protection, which highlights the need to strengthen the gender perspective in local justice.

    La evolución del delito de omisión de activos o inclusión de pasivos inexistentes en Colombia : análisis crítico del artículo 434A del Código Penal a la luz de la Ley 2277 de 2022

    The present study analyses the normative evolution of the offence of omission of assets or inclusion of non-existent liabilities in Colombia, defined by article 434A of the Penal Code, in light of the recent amendments introduced by Law 2277 of 2022. In addition, a study is carried out comparing similar crimes in Argentina, Spain and Mexico. The elements of criminal law and the challenges faced in its effective application are also analysed. Based on the above, it is concluded that the fight against tax evasion from the criminal sphere requires not only well designed rules and efficient prosecution, but also strengthening the tax culture and adopting a comprehensive and coherent criminal policy.

    This article examines Constitutional Court Ruling T-323 of 2024 and its impact on the use of AI in the evidentiary field. Through a doctrinal and jurisprudential analysis, it evaluates whether any of these tools can be considered a means of evidence in Colombian law, identifying the epistemological, legal, and procedural challenges that this implies. In particular, its relationship with the principle of evidentiary freedom will be studied and the evidence generated by this methodology of information production will be examined in the light of fundamental criteria such as authenticity, contradiction, and authorship.
