Also, there will be an analysis of comparative law with three Latin American countries that have enshrined normatively this figure. To achieve this, an extensive study was made of the Colombian legal regulations and comparative law in the legal systems of Chile, Argentina and Costa Rica Chile, Costa Rica and Argentina as well as academic articles and case law consultation. (Sogamoso's office) and Greenland S.A.S. experimented with remote work during the onset of the COVID-19 pandemic. The dataset employed in this research was collected through an open and closed questions survey conducted on a representative sample of employees of both companies, which allowed the discovery of the most relevant changes these employees faced with remote work during COVID-19. The results showed a clear preference of employees for remote work and evidenced stability in company operations despite the disruptions due to the onset of COVID-19 and the lack of preparation in implementing this type of work. To meet the established objectives, research was carried out to establish a framework for study and analysis of the different dimensions of labor well-being that must be considered when the work mechanism includes teleworking, whether in full-time or part-time mode. Once a clear conceptual framework was defined, a study was carried out with a quantitative approach through a survey that would allow collecting information on the perception of an established population group regarding the variables that would analyze the 9 dimensions for an evaluation model of the impact of the teleworking in occupational well-being. People from different types of companies within the ICT sector in Bogotá – Colombia participated in this survey. The results obtained through the analysis of the survey data made it possible to identify key aspects of the impact of teleworking on work well-being, such as some aspects being more relevant for women and men, and where they stand out as aspects with greater alteration due to the teleworking, interpersonal relationships, work overload and occupational illnesses. Method. A cross-sectional descriptive qualitative study was carried out; The research design was a case study based on semi-structured interviews with eight teleworkers from Colombian companies with a minimum of two years of teleworking experience. Results: The majority of the participants perceive that they have psychological well-being in the exercise of their position in the teleworking modality and that this perception is influenced by dimensions such as attitude, the satisfaction of needs, the social, emotional and labor implications and conditions that facilitate or hinder said psychological well-being. Conclusions: the perception of psychological well-being showed that, at a general level, it is perceived as that personal state related to experiencing tranquility, being able to have a general balance between work and life, socially, family, economically, emotionally and physically. Both the factors that hinder and those that facilitate psychological well-being at work are very diverse and correspond to both the work and personal aspects, showing physical and organizational aspects such as the workplace, remuneration or leadership, and personal aspects such as beliefs. , attitude, self-management and culture of people. In consequence, this monograph will define and compare those work alternatives and their implications in the legal system.Ítem Trabajo en casa : percepciones de los trabajadores del call center Konecta del Municipio de Itagüí, Antioquia(Universidad EAFIT, 2021) Vásquez Agudelo, Duván Darío; Betancur Hurtado, Carlos MarioPandemics have appeared throughout all human history. Currently, the world is going through one with high fatality rates: COVID-19. In Colombia and Antioquia, the first cases of contagion occurred in the first quarter of the year. By national policies, in order to mitigate the spread, the measure of mandatory confinement in the national territory is taken. This is an unknown scenario for the country and organizations. The technological advances available led by the International Labor Organization (ILO) recommend the adoption of strategies for making work more flexible, suggesting companies to migrate their employees to work at home. This is the case of the Konecta Company, which moved 90% of its DIRECTV employees to this modality in their different positions: coordinators, supervisors, advisers, trainers and experienced technicians. The objective of this research is, describe the effects of work at home on the Konecta call center workers, specifically those who provide support to the DIRECTV service. Within the framework of conceptual references, the concepts of work, telework and labor flexibility were addressed. The research study method is explorative and qualitative. As a result, it was possible to analyze the aspects generated by the current working conditions, finding a high favorability in this modality, mainly by the protection feeling by the company's decision to send them home as a prevention measure. In addition, the commitment to sustaining work performance is highlighted and other factors like savings in travel times to the headquarters, which allows them to invest more time in family and personal activities. However, the impact of excess work at home by those who occupy leading administrative roles and operations coordinators was visible; Difficulty issues in the technical solution of incidents and infrastructure, there were not the adequate tools for the development of the work, such as chairs, desks and footrests. It was concluded that the favorability for work at home was 93%, despite the fact that in terms of well-being it had a 70% approval because the absence of activities that could not be supplied and the absence of safety conditions and health at work associated with issues of active breaks and ergonomic conditions. Finally, it is recommended that the company review the possibility of regulating telework and mixed work modalities, classifying and assigning personal interest; likewise, workers with family, psychological or other problems caused by these new conditions return to the presence. Further, it would be necessary to redesign the wellness and OSH plans, adjusting them to this new modality, in order to provide the appropriate physical elements for carrying out the work: chairs, footrests, tables; review the capacity of the technology and technical support areas to speed up the resolution of incidents and, finally, carry out programs to restrict agendas and responsibilities outside of working hours, due the impact on the personal lives of workers, mainly the administrative staff.Ítem Trabajo en equipo en modalidad no presencial en el sector de la salud en Medellín durante la pandemia COVID-19(Universidad EAFIT, 2021) Zapata Ospina, Alejandro; Arévalo Novoa, Joel Fawyani; López Gallego, Francisco DaríoTelemedicine began around the 60s decade with the transmission of waves from telephone signals, presenting great advances with the advent of the internet and the transmission of large volumes of data through broadband. With the arrival of the pandemic and its restrictions, telework presented an exponential increase in institutions, transferred the care of patients from their homes. Given this important growth, it was necessary to evaluate the capacity for teamwork, cooperation, leadership, problem solving and quality of life in three health institutions in the region. A descriptive quantitative analysis and proportions differences were carried out for independent variances of the different responses. Of the total of 51 surveys, 48 met inclusion and exclusion criteria, finding that 66.6% (n = 32) of the respondents had provided the teleconsultation service, with no differences between medical and surgical specialties, they had worked for about 5.93 ± 0.65 hours a day for 9.18 ± 1.3 months. For 72% (p <0.05) of those surveyed, teleconsultation turned out to be useful and for 56.3% it was easier to collaborate with another specialty in this modality, 65; 6% report having had fewer conflicts and ease to solve them, although most of them (40.6%) prefer a face-to-face meeting to solve them. 62.5% of those surveyed have not seen their administrative functions altered and even perceive an improvement in the quality of family life, however, 59.4% report an increase in their workload. Based on these results, we can conclude that teleworking in the region is being carried out by a significant percentage of the population, it allows teamwork, cooperation, access to other specialists, it requires adaptation to the form of leadership, it has a low percentage of perception of difficulties, improves the perception of the quality of family time, but it is perceived with an increase in the workload. Method: A quantitative exploratory cross-sectional study was conducted using convenience sampling through a structured web-based self-report questionnaire. A total of 262 valid questionnaires were collected. Results: The data obtained suggest that telecommuting tends to have a particularly positive impact on the more individual aspects of telecommuters, reflected in performance and the subjective psychosocial dimension, while collective or social components that require the presence of others such as culture and the more social factors of the psychosocial dimension showed a tendency towards a greater negative impact of telecommuting, although they were also classified with a sufficient percentage to be considered as having a positive impact of telecommuting overall. Conclusions: Work as a human phenomenon, humans as social beings, and the vital role of social relationships in work warn of telecommuting as a spatial labor flexibility modality that tends to isolate and individualize collective goals into smaller or individual nuclei.
