Ítem Aplicación de las teorías de agencia y Stewardship en el análisis de las relaciones entre sello discográfico y artista en la industria musical de Medellín(2019) Montoya Sandoval, Sebastian; Téllez Falla, Diego FernandoThe music industry has undergone major changes in its business model and relationship with artists given the impact that technology has had in terms of democratization of music and access to information, changing the roles of both labels and artists. The interaction between both parts is influenced by aspects such as trust, autonomy and power, risk treatment and motivations of each of them, which configures a complex relationship that resembles the literature proposed by agency and stewardship theories. This study aimed to understand the visions of labels and artists around their needs when generating a relationship between them, through the analysis of three in-depth interviews and nine questionnaires administered to different actors in the music industry in Medellín, in order to identify mechanisms that allow a greater viability of long term relationships. It was found that these actors are aware of how technology has been changing the industry and the importance of empowering themselves with the new tools that allow potentiating all the fronts involved in an artistic project such as production, administration, promotion, distribution, among others. In addition, there are great challenges in building trust between the two, due to the old ways of relating and generating contracts without enough knowledge. However, there is currently a great willingness of all actors to fight against information asymmetry, through the appropriation of knowledge and accessible resources that allow them to work in cooperation.Ítem El blockchain y la propiedad intelectual en Colombia : perspectivas como medio de protección y como objeto de protección(Universidad EAFIT, 2022) Gómez Molina, Simón; Múnera Posada, ArmandoThe purpose of this research is to study the Blockchain in Colombia as a means of protection and, secondly, as an object of intellectual property protection. In this sense, the difficulties present in the Colombian legal framework related to the use of Blockchain technology as a means of protection are discussed, with a view to seeking strategies to solve this problem. What has this brought to law in terms of the scope and sufficiency of traditional regulations, and what are the challenges and questions that these great technologies have left to legal institutions? The beginning of this article is a compilation, in general terms, of what has been the traditional conception of law and the transformation it has undergone as a social construct. The latter is influenced by economic, social, and cultural factors of a globalized world driven by the internet and the use of new information technologies. At this point, it will be evident the relevance that modern concepts such as metaverse, intellectual property, artificial intelligence, and LegalTech have taken in recent years. Concepts that are accompanied by risks, gaps, and conflicts, and which in turn are encompassed in the same cause: the digitization of information. This article points, always, to the fact that we are and will be an eminently digital society and to the importance of information technology and the tools it offers. It is assumed that technology will continue to have an impact on the training, educational, and application areas of law because traditional methods limit the functioning and development of an advanced society. A society that demands answers, and this is where international and transnational law, technology transfer, and functional equivalents could have an impact, components that are offered as possible solutions to the challenges brought about by digitalization.Ítem Franquicia en Colombia, cómo mutaría de un contrato atípico a un contrato típico, regulación y creación de “proyecto ley” de la franquicia(Universidad EAFIT, 2023) Muñoz Mesa, Andrés Felipe; Pulgarín, Juan FernandoThis monograph analyzes the franchise in Colombia and in the world, assesing existing regulations and the behavior of this business model, establishes commercial and legal guidelines that must be adhered to ensuring the fulfillment of the relationship and contract between the involved parties in a clear and equitable manner, which are reflected in a proposal for a “Franchise Law Project” that aims to create a clear and balanced contract where the contracting parties have rights and duties that help improve their commercial relationship fostering mutual growth with a shared goal that benefits both parties. The methodology used corresponds to a qualitative descriptive-interpretive research focused on a documentary design. It centers on the interpretation of commercial law with a particular focus on franchising. This research is conducted through the compilation of historical information of legal, doctrinal, jurisprudential sources as well as national and international legal concepts. Likewise, an analysis is conducted from the 1991 Political Constitution, which in Article 151 establishes that only the Colombian Congress can enact laws regarding economic intervention, stating its purposes and scope. Similarly, Article 333 of the Constitution asserts that economic activity in Colombia is guided by the principles of a free-market system. The preceding reflects that, the appropriate process to legally establish a franchise contract is the procedure of a bill in Congress, especially when dealing with a right regulated by the industrial property regime, patents, trademarks, or other forms of intellectual property that are inherent to the franchise. First, a conceptualization of the notion of the right to the image, its positive and negative aspects as well as its moral and patrimonial content, the limits of the scope of the authorization of the use of the image and the existing ways to protect it will be made. Later on, the normative framework related to the right to the image in Colombia will be studied, where each of the regimes that develop it will be exposed in order to understand what each of these rules is about and how they contribute to the protection of the image. Afterwards, we will explain what social networks are and what their purpose is to understand why they have become a fundamental tool for brands in their advertising strategy and what implications the content of their advertising has with respect to the rights of third parties. In Medellín, we see a growing number of emerging artists in the independent music sphere. However, this new sector of the music industry is still unknown to many entrepreneurs and legal professionals, which creates imbalances in the market and can harm creators. For this purpose, we will begin by describing the creations that are protected by the mechanisms provided by intellectual property in Colombia from the scope of private law. Additionally, we will discuss the protection mechanisms provided by private law to intellectual property rights. Then, we will delimit which are the legal properties that are protected in these cases, to later analyze the crimes against intellectual property in Colombia (sections 270-272 and 306-308 of the Criminal Code), and finally to identify whether or not protection is necessary and, if so what are the shortcomings of the Colombian legal system in this regard. Most methods are subjective, have limitations and sometimes misconceptions from a financial point of view. Most of these models end up being used for the management of intangibles.
