In this sense, the difficulties present in the Colombian legal framework related to the use of Blockchain technology as a means of protection are discussed, with a view to seeking strategies to solve this problem. Regarding the methodology, the research is limited to a documentary-bibliographic research, in which the techniques for the collection and analysis of the data are the analysis of the normative hypothesis, the consultation to sources of legal knowledge and the review of the data obtained for the interpretation of the legal facts; thus, from the analysis and interpretation it was concluded that despite the advantages of the technology studied in intellectual protection, it is visualized that there are few institutions and professionals with sufficient knowledge to contribute ideas on this topic, so that a legal set for the use of the tool has not been consolidated.Ítem Convertir activos intangibles en resultados tangibles. For this purpose, first of all, the main concepts related to the subject matter will be addressed. Then, the assumptions for the criminalization of the conducts from the criminal point of view will be established, and it will be analyzed whether the conducts of copyright infringement are framed within such assumptions; and likewise, the possibility of such infringements being framed in other spheres of law will be reviewed. This controversy arises because artificial intelligence has reached a significant level of development and autonomy, enabling the creation of artistic and literary content based on instructions provided by users. However, this new reality poses legal challenges and questions the scope of copyright law. For this reason, the main purpose of this research is to determine whether such creations are protected by copyright. It also seeks to establish who should be recognized as the owner of these rights. For this purpose, different international jurisprudential positions that have established that works assisted by artificial intelligence are susceptible of being protected by copyright were examined. The methodology used corresponds to a qualitative descriptive-interpretive research focused on a documentary design. It centers on the interpretation of commercial law with a particular focus on franchising. This research is conducted through the compilation of historical information of legal, doctrinal, jurisprudential sources as well as national and international legal concepts. Likewise, an analysis is conducted from the 1991 Political Constitution, which in Article 151 establishes that only the Colombian Congress can enact laws regarding economic intervention, stating its purposes and scope. Similarly, Article 333 of the Constitution asserts that economic activity in Colombia is guided by the principles of a free-market system. The preceding reflects that, the appropriate process to legally establish a franchise contract is the procedure of a bill in Congress, especially when dealing with a right regulated by the industrial property regime, patents, trademarks, or other forms of intellectual property that are inherent to the franchise. It is for this reason that we lawyers must be prepared to know when these works of the digital age can be protected by the instruments of the intelectual property. The following research article focuses primarily on studying the shortest intellectual creations, and analyzing how much the extent of a work influences the acquisition of copyright protection. In order to analyze the importance of the extension of a work to achieve copyright protection, an analysis was made of the national laws of various countries, international treaties, various sentences and different concepts that establishes the necessary requirements so that an intellectual creation can be protected by copyright. They are often one of the most valuable assets of a company and therefore there are regulations for their registration and protection. When a trademark is registered, it gives its holder the right to prevent third parties from marketing similar products with identical or similar symbols. In trademark registration and protection processes it is necessary to determine the similarity between 2 trademarks to detect potential confusion that may mislead consumers. Traditionally, this similarity has been established through a qualitative human assessment, but given the increasing number of trademarks registration, the need to automate this task is configured. This research evaluates different techniques of Natural Language Processing (NLP), Computer Vision and phonology, applied in the context of trademark matching, to obtain a system of models that can measure visual, spelling, and phonetic similarity between trademarks. First, a conceptualization of the notion of the right to the image, its positive and negative aspects as well as its moral and patrimonial content, the limits of the scope of the authorization of the use of the image and the existing ways to protect it will be made. Later on, the normative framework related to the right to the image in Colombia will be studied, where each of the regimes that develop it will be exposed in order to understand what each of these rules is about and how they contribute to the protection of the image. Afterwards, we will explain what social networks are and what their purpose is to understand why they have become a fundamental tool for brands in their advertising strategy and what implications the content of their advertising has with respect to the rights of third parties. Finally, the rules of intellectual property law will be analyzed the rules that make up the copyright and trademark law to answer whether they are appropriate for the protection of the right to the image and why.Ítem Protección jurídica a las manifestaciones culturales de las comunidades afroatrateñas : propuesta de propiedad intelectual comunitaria sobre expresiones de vida, espiritualidad y muerte(Universidad EAFIT, 2023) Ibarguen Parra, Kristian Mariano; Escobar Blanco, Paola AndreaThis monograph is framed within the ethno-legal line of research, with the objective of identifying the rights and legal mechanisms of protection that ethnic communities, especially the Afro-atrateño community, have in relation to their traditional cultural manifestations. To achieve this, the first chapter defines the legal and ethnographic elements that allow understanding Afro-atrateño identity as an ethnic identity. In the second chapter, (1) acculturation and cultural appropriation are discussed as risks to traditional cultural manifestations; (2) a review of national and international regulations on rights and mechanisms for the protection of ethnic communities over their cultural manifestations is made; and (3) the introduction, in the Colombian legal system, of Community Intellectual Property is proposed as a right that allows recognizing ethnic communities as legitimate in law to take action seeking the cessation of the improper and/or unauthorized use and economic exploitation of their cultural manifestations. We conclude by saying that, although the Colombian legal system recognizes the right of ethnic communities to safeguard their cultural manifestations -which guarantees their survival over time-, this is not sufficient to address the situations arising from the processes of acculturation and cultural appropriation, in view of which we propose the introduction of community intellectual property as a right that allows communities to claim from third parties the exploitation of their cultural manifestations and enhance local development from the use of the economic potential underlying them. We warn the reader that in section 2.2, where the analysis of the existing national and international regulations on the protection of the culture of ethnic communities is made, it will be noted that they generally refer to "indigenous and tribal peoples"; by reference to national jurisprudence, it should be understood that their protection extends to black/Afro-Colombian communities.
