This research paper focuses on the debate on the ownership of works generated and assisted by artificial intelligence (AI), with a particular focus on literary, musical and image works. This controversy arises because artificial intelligence has reached a significant level of development and autonomy, enabling the creation of artistic and literary content based on instructions provided by users. However, this new reality poses legal challenges and questions the scope of copyright law. For this reason, the main purpose of this research is to determine whether such creations are protected by copyright. It also seeks to establish who should be recognized as the owner of these rights. For this purpose, different international jurisprudential positions that have established that works assisted by artificial intelligence are susceptible of being protected by copyright were examined. This, taking into account that the courts considered that works assisted by artificial intelligence are the product of human intellect.

El presente trabajo de investigación se centra en el debate sobre la propiedad de las obras generadas y asistidas por inteligencia artificial (IA), con un enfoque particular en obras literarias, musicales e imágenes. Esta controversia se presenta porque la inteligencia artificial ha alcanzado un nivel significativo de desarrollo y de autonomía, al permitir la creación de contenidos artísticos y literarios con base en instrucciones proporcionadas por los usuarios. Sin embargo, esta nueva realidad plantea desafíos legales y cuestiona el alcance de la normativa de derecho de autor. Por este motivo, el propósito principal de esta investigación consiste en determinar si dichas creaciones están protegidas por el derecho de autor. Asimismo, se busca establecer quién debe ser reconocido como el titular de estos derechos. Con este propósito, se examinaron distintas posiciones jurisprudenciales internacionales que han establecido que las obras asistidas por inteligencia artificial son susceptibles de ser protegidas mediante el derecho de autor. Esto, teniendo en cuenta que los tribunales consideraron que las obras asistidas por inteligencia artificial son producto del intelecto humano.
