However, this right has not been fully guaranteed to those subjects who come to the ordinary jurisdiction in search of an economic support, which guarantees a monthly income that can supply the basic needs of people who are unable to continue working, hence, there have been numerous cases in which despite not being a fundamental right in principle, and having its own judicial mechanisms to dispute it through ordinary channels, the jurisprudence of the Constitutional Court has enabled the origin of the action of protection in some cases. The foregoing leads us to the legal analysis of a group of decisions of the guardianship judges that will be carried out in this thesis, through which, it is studied how the right to a disability pension has been protected as fundamental, to defend mainly subjects of special constitutional protection such as people in a state of disability and, in turn, guarantee them fundamental rights related to this economic benefit.Ítem Determinantes sociodemográficos de la cotización a pensión : estudio de caso para Colombia, Chile, México y Perú(Universidad EAFIT, 2022) Toro Zuluaga, Gregorio; Cardona López, Juan José; Chaparro Cardona, Juan CamiloThis study aims to establish how sociodemographic determinants affect the probability of contributing to a pension in Colombia, Chile, Mexico and Peru, using logit and multinomial logit models. Likewise, it concludes that solving the structural problems of the labor markets will result in greater probabilities of contribution, regardless of the pension system. For this, were formed seven portfolios with different periods of time and different selection characteristics in order to review the profitability in terms of cash flows generated for the investor, as well as the return of the share in the period of time between the hypothetical conformation of the portfolio and March 2021, likewise a backtesting was carried out for this same period of time and an evaluation of the behavior of the portfolio in the market was carried out by comparing it with 3 financial instruments and based on this evaluation, a strategy is established that, although it is true, has greater risk, it also generates greater profitability than conventional fixed-income alternatives and that should be taken into account as a very good investment option for the pension stage.Ítem Fondos obligatorios de pensiones : ¿qué se tiene hoy con el régimen de inversiones y cómo ha evolucionado?(Universidad EAFIT, 2022) Ojeda Ramírez, Mitchell Valeria; Restrepo Ortega, Isabel; Restrepo Giraldo, Andrés MauricioTaking into account that in Colombia there are two types of pension systems, a private one, represented by the individual savings pension funds, and a public one, managed by Colpensiones. This thesis consists of a descriptive and informative work on the former, where the emphasis is placed on how they contribute to the social development of the country, beyond an individualistic conception that may be tied to the benefits of social security. The study starts from its origin, history, and the way it operates nowadays with the changes and legal regulations that have been developed. Therefore, as this thesis finds its cornerstone in the individual savings system, especially in the development of the pension fund investment system, in addition to the benefits that these have brought to the country, a complete analysis of the regulations that cover this system will be presented. On the other hand, each of the regulatory decrees that have given life to the pension investment regime will be observed, starting with Law 100 of 1993, up to the most recent decree that introduced substantial changes in the way private funds make their investments; therefore, obtain returns for the affiliates. In this way, the work will focus on understanding the forms of investment, the different risk profiles, the creation of the multifunds, the evolution of the scheme, and its challenges. In the case of old-age pensioners, the transition from an active to an inactive stage of work can trigger crises and significant changes in all aspects of their lives, that is, in their health and in their economic, psychological, social and family situation. Colombian organizations should include, within their wellness programs, the component of preparation for this stage that provides their employees, who are close to retirement, the necessary guidance, tools and knowledge to face this new stage of the life cycle. This qualitative-descriptive research aims to explore the effects of retirement preparation programs on the quality of life of Colombian pensioners, through the application of a semi-structured interview to four pensioners and four leaders or those in charge of designing and / or executing said programs in organizations in Colombia. The obtained data facilitated the identification of the main characteristics of the programs to prepare for this stage, understanding the meaning of retirement for some pensioners and perceiving the effects on certain aspects of the quality of life of the interviewees. Throughout the history of labor law and social security in the country, this protection has taken various forms and has been entrusted to different actors. Due to the fact that the protection of this risk has been defined and redefined by each of the regulatory regimes that the legislator has designed, difficulties have arisen in the normative succession during the implementation of each regime. These difficulties have represented obstacles in the recognition of pension rights for Colombians, with the most common cases being those related to the omission of affiliation. Therefore, invoking the guarantee of fundamental rights, the Labor Chamber of the Supreme Court of Justice has refined its jurisprudence, attempting to address these difficulties that have significantly affected the minimum labor rights of workers for many years.
