In Colombia, the Convention was approved by Law 518 of 1999 and ratified in 2001, entering into force on August 1, 2002. Its main objective is to facilitate international trade through uniform rules, avoiding recourse to the domestic law of each country. One of the key concepts in the CISG is the "place of business" of the parties, which is relevant to determining its application in international contracts. If a party has more than one establishment, the one with the closest relationship to the contract will be taken into account. This article will analyze how different courts have interpreted the concept of place of business, emphasizing that it should be understood as a stable and independent place of economic activity. Cases in which the term "place of business" has been applied will be examined to determine whether the CISG applies. Additionally, the Colombian legal system's rules that must be taken into account to harmonize the concept of place of business in the CISG and how it should be understood in Colombia are set forth.Publicación Smart Contracts, el reto de la innovación legal y tecnológica en Colombia(Universidad EAFIT, 2024) Martínez Restrepo, Mariana; Gómez Jaramillo, SthepanieSmart Contracts have emerged as an innovative technology linked to the blockchain that promises to revolutionize how we carry out transactions and agreements. In the Colombian context, its adoption poses challenges and opportunities in legal, technological, and legal security terms. This monographic article aims to explore the foundations and applications of Smart Contracts, understanding their operation and practical implementation in various sectors such as business intelligence, the public sector, the health sector, the banking sector, the financial sector, and the insurance sector. In addition, the current legal framework in Colombia and its adaptation to this emerging technology will be examined, considering aspects of privacy and data protection. Likewise, legal security challenges and measures to mitigate risks associated with the implementation of Smart Contracts will be addressed. The research will also focus on future challenges and prospects for the mass adoption of this technology, considering interoperability, dispute resolution, and the construction of an adequate regulatory framework.
