Publicación Análisis del artículo 19 de la ley 2466 de 2025 e implicaciones de su aplicación retroactiva(Universidad EAFIT, 2025-09-29) Arias Prisco, Adriana María; Javier Tamayo, FranciscoThis thesis examines the interpretation of Article 19 of Law 2466 of 2025 and its implications for Colombian criminal law, particularly regarding the penitentiary policy of sentence redemption as a mechanism of resocialization (Colombia, Congreso de la República, 2025, art. 19). The provision not only serves as a tool to shorten periods of incarceration but also represents an effective means of safeguarding fundamental rights of persons deprived of liberty, such as human dignity, equality, due process, and the resocializing function of punishment. The potential retroactive application of this article, based on the principle of favorability, could generate a significant legal and social impact by reducing prison overcrowding and improving reintegration conditions. Considering the Constitutional Court’s recognition of an unconstitutional situation in the prison system, this study argues for an interpretation that enhances fundamental rights protection and contributes to the humanization of the penitentiary system.Publicación Derecho a la libertad de expresión : más allá del derecho penal(Universidad EAFIT, 2025) Urán Buitrago, Luisa María; Cadavid Quintero, AlfonsoThe protection provided by international organizations and various states to the right of freedom of speech has undoubtedly generated an erroneous but quite common idea: that freedom of speech covers expressions loaded with hatred, insults and discrimination. This notion completely forgets that the rights to honor, privacy and human dignity serve as insurmountable limits to this right. The idea of criminal intervention as the first defense mechanism against the offenses that freedom of expression can generate has been ineffective in today's society. Various constitutional courts offer mechanisms to solve the latent conflict between these blocks of fundamental rights. It is undeniable that the rise of social networks completely changed the way we communicate. Today, we are one click away to find out what is happening in our country and the world. Social networks are characterized by the immediacy of information, since they lack of censorship and respect for the other; but they play a prominent role in the search for truth. The study began with the recognition that, although there is a growing body of international and regional regulations on these matters, their implementation faces multiple challenges, particularly in contexts like Colombia. Through a dogmatic and historical-legal analysis of international treaties, soft law standards, European and Latin American regulations, and national legal frameworks, the study examined the evolution of transnational law and its capacity to influence corporate conduct in relation to climate change. The research found that, while Colombia has adopted international commitments and domestic regulations, normative gaps, institutional weakness, and a lack of coordination between public and private actors persist. It concluded that these limitations hinder the effective implementation of transnational standards in the country, affecting its alignment with international demands, especially those from the European Union. Colombia has not been the exception to this rule. But the historical development of this doctrine showed its inability to address situations of tension between the different branches of public power or other organs that structure modern states. For this reason, the content of this article is to show the importance of the principle of the armonic collaboration for the Colombian State around transitional justice circumstances such as the one developed through law 1448 of 2011, kwon as the Victims Law. However, the transitional justice process prescribed in Law 1448 of 2011 is ineffective as a consequence of the lack of institutional coordination between the entities in charge of 5 implementing it. Despite the existence of a robust regulatory framework and international commitments made by the State, this practice persists and even increased during 2024. The objective is to identify whether the distributive justice measures implemented in the Colombian legal system are sufficient to prevent this phenomenon. Using a qualitative methodology based on the analysis of documentary sources from the perspective of legal philosophy, the results offer a critical reflection that urges the Colombian State to reorient its efforts towards transforming the structural conditions that perpetuate the vulnerability and exposure of minors to armed actors.Publicación La dignidad humana : (art. 1 del Código Penal Colombiano) como límite a la libertad de configuración del legislador en materia penal(Universidad EAFIT, 2013) Serna, Yolanda María… En el presente trabajo se analizará de qué manera la Dignidad Humana, proclamada como principio y norma rectora del Derecho Penal, puede limitarlo. Para ello se estudiarán las sentencias más relevantes que la Corte Constitucional ha emitido sobre los tipos y el quantum de las penas imponibles, la tipificación de delitos, y la aplicación de subrogados penales, desde el año 2000 hasta el 2011. Así, el objeto de estudio de esta investigación es analizar cómo la dignidad humana se configura en límite a la libertad de configuración del legislador en materia penal, específicamente en lo relacionado a imposición de penas, aplicación de subrogados penales, y tipificación de conductas. Es importante aclarar también, que cuando se indaga por la Dignidad Humana como límite a la potestad de libre configuración del legislador en materia punitiva, se incluye en el escenario el principio de proporcionalidad (con sus contenidos relativos a la razonabilidad y necesidad), pues como lo establece Luigi Ferrajoli en su tratado sobre Garantísmo Penal, entre los múltiples límites que en un Estado de Derecho tiene el legislador están los de legalidad, igualdad, certeza, necesidad y proporcionalidad. Siendo estos últimos principios integrantes de la dignidad humana8, que cuestionan un tipo de pena o la “naturaleza de la misma”, y el quantum o la cantidad de pena que se reputa legítima en un Estado de Derecho.
