    The purpose of this paper is to analyze, in the light of Colombian criminal law, whether it is really necessary to penalize the conducts that infringe copyrights or whether, on the contrary, it is possible to prosecute such conducts by different means given by the different legislative mechanisms in force in other areas of the law. For this purpose, first of all, the main concepts related to the subject matter will be addressed. Then, the assumptions for the criminalization of the conducts from the criminal point of view will be established, and it will be analyzed whether the conducts of copyright infringement are framed within such assumptions; and likewise, the possibility of such infringements being framed in other spheres of law will be reviewed. Finally, it will be determined which legislation applicable to the matter is more convenient and effective to repair the damage caused to the holders of this right by the infringement thereof.

    Property has been an intrinsic concept to the existence of humanity.     This research paper focuses on the debate on the ownership of works generated and assisted by artificial intelligence (AI), with a particular focus on literary, musical and image works. This controversy arises because artificial intelligence has reached a significant level of development and autonomy, enabling the creation of artistic and literary content based on instructions provided by users. However, this new reality poses legal challenges and questions the scope of copyright law. For this reason, the main purpose of this research is to determine whether such creations are protected by copyright. It also seeks to establish who should be recognized as the owner of these rights. For this purpose, different international jurisprudential positions that have established that works assisted by artificial intelligence are susceptible of being protected by copyright were examined. This, taking into account that the courts considered that works assisted by artificial intelligence are the product of human intellect.

However, smart contracts are not left behind either, since their boom has been due to their easy application and security when entering into business deals; this is why both intertwined topics provide us with an insight into global legal problems where the effectiveness of technology applied to new legal terms is evident, demonstrating that law is a discipline that needs constant updating.

    El blockchain y la propiedad intelectual en Colombia : perspectivas como medio de protección y como objeto de protección

    The purpose of this research is to study the Blockchain in Colombia as a means of protection and, secondly, as an object of intellectual property protection. In this sense, the difficulties present in the Colombian legal framework related to the use of Blockchain technology as a means of protection are discussed, with a view to seeking strategies to solve this problem. Regarding the methodology, the research is limited to a documentary-bibliographic research, in which the techniques for the collection and analysis of the data are the analysis of the normative hypothesis, the consultation to sources of legal knowledge and the review of the data obtained for the interpretation of the legal facts; thus, from the analysis and interpretation it was concluded that despite the advantages of the technology studied in intellectual protection, it is visualized that there are few institutions and professionals with sufficient knowledge to contribute ideas on this topic, so that a legal set for the use of the tool has not been consolidated.

    This study is classified into qualitative-descriptive research applying the hermeneutical method in order to interpreting the legal primary and secondary sources by exegetical approach. Thus, this study seeks to evidence the achievement of the protection of the author's moral rights in the Constitutional, as well as in the international and national regulations, focusing on the right of paternity regarding the authors' works by reviewing the fields that are involved in the regula-tion of these violations at the criminal law level. Therefore, the decisions adopted by the High Courts on copyright moral rights are reviewed, especially, the interpretation of the criminal type established by Article 270 of Law 599 of 2000 by the Criminal Cassation Tribunal of the National Court of Justice through Judgment 31403 of May 28th of 2010, executed by M.P. Sigifredo Espinosa Pérez.

    The fashion industry, understood as the economic and industrial activity that aims to regulate the interactions and commercial relations of fashion, is one of the most important industries today, with global revenues of 1.7 trillion dollars in 2021 (Fahion United, n.d., para. 6). However, this industry has a number of particularities that make its legal protection not only necessary, but also unique to the industry. Thus, characteristics such as the constant search for trends, the constant change and dynamism, the prevalence of intangible assets resulting from the ingenuity of designers, or the dual utilitarian and aesthetic dimension of fashion designs make it necessary to have a robust legal regime that responds to the particular needs of this industry. Among the multiple legal protection mechanisms that have been established in order to safeguard the designs of the fashion industry and to promote originality and innovation, the Intellectual Property regime is a mechanism that is considered essential, since it offers different legal alternatives that manage to provide protection for the intellectual creativity of designers. In particular, trademark law has become a recurrent mechanism used by designers and fashion houses to grant legal protection to their logos and expressions, but also to more particular elements such as designs and elements within them. This is because trademarks enable the construction of close relationships between consumers and entrepreneurs. Thus, said signs create an almost immediate association of concepts and positive feelings towards a particular business origin. On the other hand, trademarks provide more durable legal protection than other Intellectual Property rights, such as industrial designs or copyrights. Therefore, trademarks become allies of the fashion industry and manage to grant extended legal protection to several aspects of the fashion industry that, traditionally, did not enjoy an effective protection mechanism. This research will define the different ways in which trademarks, both traditional and non-traditional, can provide legal protection to the fashion industry. In addition, cases from the Colombian context will be used to evaluate the effective materialization of trademarks in the fashion industry. On the other hand, reference will be made to recognized cases from around the world, with the aim of demonstrating the different nuances and understandings that are generated around trademark protection in the fashion industry. In accordance with the above, the challenges faced by the fashion industry in terms of trademark protection will become evident from this analysis. Among these challenges are the lack of homogenized criteria in relation to non-traditional trademarks, the possible limitation to free competition by granting undefined trademark rights, and other criteria that will be developed in this research. Finally, mention will be made of possible alternatives to be implemented as a mechanism for resolving the problems raised throughout the research.

    Intangible assets are an important component of the market value of a company, especially brands that represent the competitive advantage of the company to sell a particular product or service; however, neither the accounting nor the finances propose an appropriate method for valuing them. Most methods are subjective, have limitations and sometimes misconceptions from a financial point of view. Most of these models end up being used for the management of intangibles.

This intangible cultural heritage, transmitted from generation to generation, is constantly recreated by communities and groups in response to their environment, their interaction with nature and their history, and provides them with a sense of identity and continuity, thus promoting respect for cultural diversity and human creativity.

    The proper management of intangible intellectual property assets is essential for the success of the business models of any agent in the cultural and creative sectors. This thesis analyzes the importance of understanding how to manage, organize, and utilize intangibles, focusing on intellectual property and its different branches, specifically copyright and industrial property. Current public policies that allow effective management of intellectual property and the needs of agents in the cultural and creative sectors are examined. Finally, possible strategies are proposed to manage intellectual property intangible assets.
