In this sense, the difficulties present in the Colombian legal framework related to the use of Blockchain technology as a means of protection are discussed, with a view to seeking strategies to solve this problem. Regarding the methodology, the research is limited to a documentary-bibliographic research, in which the techniques for the collection and analysis of the data are the analysis of the normative hypothesis, the consultation to sources of legal knowledge and the review of the data obtained for the interpretation of the legal facts; thus, from the analysis and interpretation it was concluded that despite the advantages of the technology studied in intellectual protection, it is visualized that there are few institutions and professionals with sufficient knowledge to contribute ideas on this topic, so that a legal set for the use of the tool has not been consolidated.Ítem Criminalización por la violación a los derechos de autor en Colombia : análisis crítico(Universidad EAFIT, 2021) Porras Salazar, Laura; Zuluaga Arbeláez, Natalia; Escobar Vélez, SusanaThe purpose of this paper is to analyze, in the light of Colombian criminal law, whether it is really necessary to penalize the conducts that infringe copyrights or whether, on the contrary, it is possible to prosecute such conducts by different means given by the different legislative mechanisms in force in other areas of the law. For this purpose, first of all, the main concepts related to the subject matter will be addressed. Then, the assumptions for the criminalization of the conducts from the criminal point of view will be established, and it will be analyzed whether the conducts of copyright infringement are framed within such assumptions; and likewise, the possibility of such infringements being framed in other spheres of law will be reviewed. This controversy arises because artificial intelligence has reached a significant level of development and autonomy, enabling the creation of artistic and literary content based on instructions provided by users. However, this new reality poses legal challenges and questions the scope of copyright law. For this reason, the main purpose of this research is to determine whether such creations are protected by copyright. It also seeks to establish who should be recognized as the owner of these rights. For this purpose, different international jurisprudential positions that have established that works assisted by artificial intelligence are susceptible of being protected by copyright were examined. As an approximation of the latter, the strength of intellectual property rights (IPRs) and country risk are used in order to consider the institutional and macroeconomic aspects, respectively. Through a fixed effects model and Tobit model with random effects, we have found that stronger IPRs promote an increase in offshoring flows. On the other hand, when the entire sample is considered (developed and developing countries), riskier countries receive higher offshoring flows, but when the sample only includes emerging countries, the relationship is reversed.
