To achieve this objective, it was necessary to go to sources of information such as specialized books on IHL, reports from the United Nations and the International Committee of the Red Cross, and, to press sources that allow an in-depth investigation to be carried out. Through this work, it was found that during the armed conflict there has been multiple violations of IHL, affecting the life and well-being of the civilian population. This international legal regime has not been enough to provide real protection to the people protected by it, concluding in the need for a review and consolidation of the international instruments of the law of war to face the challenges of a contemporary armed conflict.Publicación El reconocimiento judicial de río Magdalena como víctima del conflicto armado : un aporte a la construcción de paz ambiental en Colombia(Universidad EAFIT, 2023) Agudelo Saldarriaga, Irene; Benavides Carrillo, Valentina; Vallejo Piedrahíta, CatalinaPublicación Estimación de los efectos de las áreas protegidas en Colombia : un enfoque desde el conflicto armado interno y la pobreza (1993-2005)(Universidad EAFIT, 2019) Calle Gómez, Humberto; Fiallo Acevedo, Santiago; Gómez Toro, Catalina; Zapata Tamayo, PabloProtected areas have been conceived as a powerful instrument to generate mechanisms for the protection and conservation of the environment, the declaration of these areas generates important impacts on the dynamics of the communities that surround them because, although they prevent these individuals from generating actions to exploit the territories, they can also prove to be important sources of income such as tourism. Colombia appears to be a case of major interest in the study of this type of zone in relation to the efects it may have on their communities, this is due to the fact that this country enjoys a vast territory with diferent thermal oors and a large number of natural areas that have been declared protected by the State, however, Colombia turns out to be even more particular because the internal armed con ict that it has experienced throughout its history has made the State's presence in certain territories difcult, therefore it is necessary to estimate whether the declaration of protected areas has generated impacts taking into account this problem of governance or whether, on the contrary, these declarations have had no impact as the presence of groups is taken into account.Publicación Factores de éxito de la reincorporación en las dimensiones de sostenibilidad económica y comunitaria, en clave de construcción de paz en los Montes de María(Universidad EAFIT, 2020) Aguilera Torres, Kely Sofía; Vargas Sáenz, Mario EnriqueThis work contains the results of a research process that takes as a study focus at Asociación Paz y Vida in Montes de María, an associative collective made up of ex-combatants from the Farc - Ep and people from the community of Damasco (rural community of Ovejas) and whose and whose experience is a work reference of the Reincorporation Process framed in the signing of Peace Agreements between the Colombian government and the guerrilla group FARC-Ep. The basis of the study are two explicit components of the long-term reincorporation route: Economic and community sustainability, studied in the key of building peace in Montes de MaríaPublicación “Falsos positivos”: eufemismos y otras estrategias que influyen en las representaciones mentales(Universidad EAFIT, 2022) Valencia Gil, Juan Carlos; López Franco, Sonia InésThe Jurisdicción Especial para la Paz (JEP) revealed that at least 6,402 people were killed in Colombia between 2002 and 2008 to present them as casualties in combat. This is the period with the most cases of these homicides committed, to a large extent, by members of the Public Force, events that are known in the country as “false positives”. The article intends to explore the effects that the use of the phrase “false positives” generates in the mental representations of readers, based on identifying discursive strategies, such as euphemism. From the sociocognitive analysis of discourse, proposed by Teun van Dijk, we reviewed 20 press headlines issued by Colombian media in 2021, in which we found that the use of “false positives” is a euphemism positioned in the discourse of the media, which contributes to strategically cover up a criminal phenomenon that victimized thousands of civilians.Ítem Guerra civil y Estado : una revisión a la incompatibilidad de dos conceptos = Civil war and State : a review of the incompatibility of two concepts(Universidad EAFIT, 2011-03) Fortou R., José Antonio; Universidad EAFITPublicación La amenaza sin rostro : derecho internacional humanitario y terrorismo(Universidad EAFIT, 2020) Tisnés Zapata, Eduardo; Toro Valencia, Jose AlbertoSince the mid 20th Century, states have begun to abandon confrontations between them. This phenomenon has had several explanations from different perspectives such as military and legal theories. In addition, international treaties have forbidden the unjustified use of force from one state against another, making illegal the start of an international conflict. This prohibition was strengthened by the UN Charter and its requirements for war. However, conflict has not come to an end, it has transformed into a confrontation between legitimate state forces and insurgent groups. These insurgencies have used non-conventional means of war to impose their will. These new means include, among others, terrorist acts, which are prohibited in the course of conflict. As terrorism represents one of the biggest threats to international security, it is important to have a complete unique definition of it, nevertheless, this has been impossible due to the complex international political reality. Now, terrorist organizations have violated International Humanitarian Law as they do not respect rules of conventional conflict. The necessity to reform the legal framework of this modern warfare has become an issue, as state agents are bound to act under International Humanitarian Law when terrorists are not.Publicación La aplicación del concepto de Justicia transicional en Colombia, una mirada a la reparación(Universidad EAFIT, 2014) Duque Molina, Manuela; Villa Jaramillo, Simón; Toro Valencia, José AlbertoPublicación La capacidad coercitiva del Estado central y la presencia violenta de actores armados no estatales(Universidad EAFIT, 2020) Herrera Jaramillo, Juan David; Mustafá Silva, NayuaThis article addresses the effect of the central State’s coercive capacity in the presence of non-state armed actors in Antioquia. To do this, we selected and classified 89 municipalities into nine groups according to their coercive capacity, from lowest to highest, then we crossed them with the variable of violent presence of non-state armed actors from 2012 to 2017. The results coincide with the theoretical postulates of authors such as Tilly (1977), Hendrix (2015) and Sepp (2005), according to which the weakness of a State, in its repressive dimension, can become an opportunity for contenders to challenge its alleged monopoly of legitimate physical violence. And likewise, its strength becomes a deterrent. In this sense, the empirical evidence shows that the Antioquia municipalities with the greatest coercive capacity have, on average, fewer acts of violent presence by non-state armed actors.
