Alcance del concepto de familia como base para la constitución del patrimonio inembargable de familia a la luz de la legislación colombiana

Resumen
The purpose of this monograph is to identify the scope of the concept of family, established by the Colombian legal system, carrying out an analysis of the legal figure under study, based on its fundamental characteristics, procedures and requirements, to build a clear and accurate writing, which seeks to establish whether the intention of the legislator in protecting the family and its assets, covers all family units, or on the contrary, there is an express limitation for some family groups by not complying with the characteristics derived from the Colombian legal system.
Now, in addition to the above, an analytical work will be carried out, of the legal figures, regulations, jurisprudence in the light of the Colombian legislation will be carried out, however, a comparative analysis will be made in the light of the Mexican and Argentinean legislation, with the purpose of establishing the concept of the institution of family at the time of constructing an attachable family patrimony.

La presente monografía tiene como propósito identificar el alcance del concepto de familia, establecido por el ordenamiento jurídico nuestro, llevando a cabo un análisis de la figura jurídica en estudio, tomando como base sus características fundamentales, procedimientos y requisitos, para construir un escrito claro y acertado, que busca establecer si la intención del legislador en proteger la familia y a sus bienes, abarca a todos los núcleos familiares, o por el contrario, existe una limitación expresa para algunos grupos familiares al no cumplir con las características derivadas impuestas por el legislador.
Además, a lo anterior, se llevará a cabo una labor analítica, de las figuras jurídicas, normatividad, jurisprudencia a la luz de la legislación colombiana, empero, se realizará un análisis comparativo a la luz de la legislación mexicana y argentina, con la finalidad de establecer el concepto de la institución de familia a la hora de construir un patrimonio inembargable de familia.
