dc.descriptionEl propósito del presente trabajo es determinar si el marco regulatorio de seguridad vehicular que se encuentre vigente en Colombia es o no deficiente, y en caso de serlo, identificar las razones que explican esa deficiencia. Para alcanzar los objetivos, se definió el concepto de seguridad vehicular, se revisó la normatividad internacional aplicable a la materia, se revisaron diferentes ordenamientos jurídicos y se estudiaron la forma y el contenido del marco regulatorio vigente en Colombia. A raíz de lo anterior, se observó que este marco regulatorio es deficiente y, a partir de allí, se buscó identificar algunas razones que explicaran dicha deficiencia. En ese sentido, se desarrollaron como posibles razones: (i) la falta de voluntad política, (ii) el lobby industrial y, (iii) los fenómenos de mercado. A lo largo del trabajo se identificó que Colombia ha emprendido algunas iniciativas para corregir esta situación; de las cuales, la más relevante hasta el momento es la ratificación de uno de los acuerdos del WP.29, sin embargo, aún existe camino por recorrer para lograr que la regulación en materia de seguridad vehicular en Colombia contribuya a alcanzar los objetivos de reducción de siniestralidad vial fijados por la comunidad internacional.spa
dc.description.abstractThe purpose of this study is to determine whether the current vehicle safety regulatory framework in Colombia is deficient or not, and if so, to identify the reasons that explain this deficiency. To achieve these objectives, the concept of vehicle safety was defined, the international regulations applicable to the subject were reviewed, different legal frameworks were analyzed, and the form and content of the current regulatory framework in Colombia were studied. As a result, it was observed that this regulatory framework is deficient, and from there, some reasons that explain this deficiency were identified. In this sense, possible reasons were developed, such as: (i) lack of political will, (ii) industrial lobbying, and (iii) market phenomena. Throughout the study, it was identified that Colombia has undertaken some initiatives to correct this situation, of which the most relevant so far is the ratification of one of the WP.29 agreements. However, there is still a long way to go to ensure that vehicle safety regulation in Colombia contributes to achieving the goals of reducing road accidents set by the international community.spa
