dc.descriptionMost responsible and decisive participation are two legal categories of great current relevance in Colombian transitional justice. These are concepts incorporated into the Constitution thanks to two constitutional amendments that have specified aspects that should guide the justice in this area. Despite their importance, the doctrinal and jurisprudential development of these normative provisions has been very limited, especially with regard to the recently created concept of decisive participation. In this sense, the purpose of this article is to review the normative and case law on both legal categories in order to determine their origins, scope, convergences and divergences and, to propose some approaches to their practical use in the Special Jurisdiction for Peace.eng
dc.descriptionMáximos responsables y participación determinante constituyen dos categorías jurídicas con mucha relevancia actual en la justicia transicional colombiana. Se trata de conceptos incorporados en la Constitución gracias a dos reformas constitucionales que han precisado aspectos puntuales que deben orientar la administración de justicia en este ámbito. Pese a su importancia, el desarrollo doctrinal y jurisprudencial de estas disposiciones normativas ha sido reducido, sobre todo frente al recién creado concepto de participación determinante. En ese sentido, este artículo se propone hacer un recuento normativo y jurisprudencial sobre ambas categorías jurídicas, con la finalidad de indagar en sus orígenes, alcances, convergencias y divergencias y a partir de ahí proponer algunos planteamientos frente a su uso práctico en la Jurisdicción Especial para la Paz.spa
