dc.description	Las políticas públicas permiten ejecutar acciones que incidan favorablemente en la vida de los ciudadanos y transformen las condiciones sociales en los territorios (Ortegón, 2020). Atendiendo a lo anterior, las políticas públicas sobre discapacidad deben promover a las personas en situación de discapacidad como sujetos de derecho y como principales legitimadores de estas, con el fin de garantizar el ejercicio pleno de sus derechos, ofreciendo oportunidades y buscando una transformación cultural y social (Barton, 2008, pp. 19-33). Con la ley 1145 de 2007, se crean cuatro niveles para el Sistema Nacional de Discapacidad, dentro de los cuales están Los Comités Municipales y Locales de Discapacidad –CMD o CLD– como niveles de deliberación, construcción y seguimiento de la política pública de discapacidad, ley que está reglamentada por la resolución 3317 de 2012 que le endilga a estos comités municipales, entre varias funciones, la de organizar la información relevante relacionada con el tema de discapacidad en el municipio o localidad, identificando las necesidades de las personas con discapacidad, los proyectos y programas existentes que aportan a la inclusión y participación de las personas con discapacidad, así como los programas, proyectos y servicios requeridos para aportar a la inclusión social de las personas de esta población. Aunado a lo anterior, la ley 1618 de 2013 ordena establecer disposiciones para garantizar el pleno ejercicio de los derechos de las personas con discapacidad. En el artículo quinto de esta ley, los municipios son responsables de asegurar que todas las políticas, planes y programas, garanticen el ejercicio total y efectivo de los derechos de esta población. En atención a esta ley, en Medellín, las políticas públicas implementadas, respecto de las personas con discapacidad, deben permitir la participación efectiva de esta población, discutiendo si se cumple con el objetivo de inclusión social y la eliminación de barreras de acceso al goce efectivo de los derechos (sentencia C-605 de 2012), en la planeación, implementación y revisión de políticas públicas. Adicional a lo anterior, y con el foco en la población sorda de la ciudad de Medellín, la cual enfrenta desafíos de comunicación para el goce efectivo de sus derechos, se revisa si en la ciudad hay políticas públicas específicamente dirigidas para las personas sordas y si las mismas han tenido participación efectiva en la planeación, ejecución y revisión de estas políticas.

In light of the above, public policies on disability must promote people with disabilities as subjects of law and as their primary legitimizers, in order to guarantee the full exercise of their rights, offering opportunities and seeking cultural and social transformation (Barton, 2008, pp. 19-33). Law 1145 of 2007 created four levels for the National Disability System, including the Municipal and Local Disability Committees (CMD or CLD) as the levels of deliberation, construction, and monitoring of public disability policy. This law, regulated by Resolution 3317 of 2012, assigns these municipal committees, among other functions, the responsibility of organizing relevant information related to the issue of disability in the municipality or locality, identifying the needs of persons with disabilities, existing projects and programs that contribute to the inclusion and participation of persons with disabilities, as well as the programs, projects, and services required to contribute to the social inclusion of persons with disabilities. In addition to the above, Law 1618 of 2013 mandates the establishment of provisions to guarantee the full exercise of the rights of persons with disabilities. Article 5 of this law stipulates that municipalities are responsible for ensuring that all policies, plans, and programs guarantee the full and effective exercise of the rights of this population. In addition to the above, and with a focus on the deaf population of the city of Medellín, which faces communication challenges in order to effectively enjoy their rights, this review examines whether there are public policies specifically directed at deaf people in the city and whether they have had effective participation in the planning, implementation, and review of these policies.
