This paper examines the renewed debate on the age of criminal responsibility in Colombia after the Miguel Uribe Turbay case, not as an isolated event or a merely emotional controversy, but as evidence of a long-standing institutional tension. Colombia has not fully resolved how to respond to serious harm committed by adolescents while still recognizing their developmental condition and their special constitutional protection. The study argues that the issue cannot be reduced to a binary opposition between minors and criminals. That framing is politically powerful, but it obscures the constitutional, statutory and international foundations of the Juvenile Criminal Responsibility System. Drawing on Law 1098 of 2006, constitutional case law, the standards of the Committee on the Rights of the Child and comparative experiences, the paper shows that the core problem is not only the minimum age of criminal responsibility, but the gap between the restorative promise of the system and what victims, families and communities actually perceive. The main thesis is that the most legally consistent path is not to transfer adolescents to the adult criminal system, but to materially reform the juvenile system so that sanctions become protective, educational, restorative, measurable and socially credible.

Este escrito revisa el debate sobre la edad de imputabilidad en Colombia a partir del caso Miguel Uribe Turbay, no como un episodio aislado ni como una simple controversia de coyuntura, sino como el síntoma de una incomodidad que se ha vivido en el país, ya que aún se decide sobre cómo sancionar a un adolescente que comete un daño grave sin borrar, al mismo tiempo, su condición de persona en desarrollo. La investigación discute que no puede reducirse a la pregunta emocional de si se trata de menores o criminales, esto es un golpe directo a la opinión pública, pero deja por fuera la arquitectura constitucional, legal e internacional del Sistema de Responsabilidad Penal para Adolescentes. Aquí se realiza un análisis de la Ley 1098 de 2006, de la jurisprudencia constitucional, de los estándares del Comité de los Derechos del Niño y de experiencias comparadas para mostrar que el problema más agudo no está solamente en la edad mínima, sino en la distancia entre lo que promete el sistema restaurativo y lo que muchas víctimas, familias y comunidades perciben de esto. La tesis central es que la salida más consistente no es trasladar adolescentes al sistema penal adulto, sino reformar de manera seria el SRPA para que sus sanciones sean protectoras, educativas, reparadoras, medibles y socialmente creíbles.
