dc.description	Este artículo profundizará sobre la problemática del fenómeno de la corrupción y en las consecuencias que este genera al interior del arbitraje internacional de las inversiones, con el objetivo de propender por el fortalecimiento de dichos sistemas en materia anticorrupción como una medida complementaria ex ante a otras herramientas de soft law, encaminada a disminuir el riesgo de inadmisión de las solicitudes presentadas por las sociedades ante el Centro Internacional de Arreglo de Diferencias Relativas a Inversiones – CIADI, por alegaciones de corrupción en contra de las mismas. Para ello, la metodología implementada se basa en un investigación jurídica, debido a que se realizará una búsqueda exhaustiva de fuentes formales y soft law, con el objetivo de visibilizar las regulaciones existentes en materia de corrupción y plantear elementos clave sobre la forma en que las sociedades pueden abordar sus sistemas de cumplimiento anticorrupción. Dentro de los primeros hallazgos, se puede mencionar que, a pesar de que la corrupción es una conducta que se ha manifestado desde el inicio de las civilizaciones, actualmente no ha sido posible establecer mecanismos jurídicos eficientes ni autosuficientes para combatirla, sancionarla y erradicarla, generando que la lucha contra este fenómeno tome cada vez mayor relevancia tanto a nivel nacional como internacional. Ello devela la pertinencia de integrar herramientas complementarias que refuercen entre sí la gestión y contención de la corrupción.
dc.description.abstract	This article will delve into the problem of the phenomenon of corruption and the consequences it generates within the international investment arbitration, with the aim of advocating for the strengthening of such systems in anti-corruption matters as a complementary measure ex ante to other soft law tools, aimed at reducing the risk of inadmissibility of applications filed by companies before the International Centre for Settlement of Investment Disputes - ICSID, due to allegations of corruption against them. For this purpose, the methodology implemented is based on legal research, due to the fact that an exhaustive search of formal and soft law sources will be carried out, with the objective of making visible the existing regulations on corruption and raise key elements on the way in which companies can approach their anti-corruption compliance systems. Among the first findings, it can be mentioned that, even though corruption is a behavior that has been manifested since the beginning of civilizations, currently it has not been possible to establish efficient legal mechanisms to combat, punish and eradicate it, generating that the fight against this phenomenon is becoming increasingly relevant both nationally and internationally. This reveals the relevance of integrating complementary tools that reinforce each other in the management and containment of corruption.
