    La mediación como mecanismo complementario al arbitraje inversionista-Estado : ¿una alternativa al enfoque adversarial? Algunas reflexiones a la luz de la mediación entre Aris Mining y la República de Colombia

    This paper analyzes how mediation, as a mechanism complementary to the investor–State dispute settlement (ISDS) system, can help address the criticisms concerning the legitimacy and efficiency of investment arbitration as an inherently adversarial mechanism. Drawing on reform proposals put forward by the United Nations Commission on International Trade Law (UNCITRAL) and the case study of Aris Mining Corporation vs. Republic of Colombia, the research examines the potential of mediation to facilitate the early resolution of disputes and to strengthen confidence in the system. The methodology combines normative and doctrinal analysis with a case study, allowing for an evaluation of the practical application of alternative dispute resolution mechanisms in the Colombian context. The study aims to contribute to the debate on the modernization of ISDS and the State’s legal defense in investment disputes.
