Ítem Análisis del reconocimiento jurídico de las labores domésticas en Colombia desde la entrada en vigencia de la Constitución Política de 1991(Universidad EAFIT, 2024) Escobar Molina, Santiago; Álvarez Cuervo, Sofía; Múnera Posada, ArmandoThis monograph seeks to analyze the regulations in force in the Colombian legal system governing domestic work in light of the axiological principles of the 1991 Political Constitution, its evolution over the last 33 years, and how the jurisprudence of the Constitutional Court has transformed the recognition of this type of labor within the national regulatory framework. This analysis stems from the need to study the metamorphosis of the rights and guarantees that, over the years, have been granted to people who perform domestic work, to determine whether there is currently full recognition and legal protection and how to advance, from a gender perspective, in the fight for equity and decent working conditions. Determining the current degree of recognition of domestic work is fundamental in the search for equality given the historical discrimination by society, and neglect by the law. Despite significant progress compared to past decades, there is still a long way to go to achieve the justice that has long been denied. Today, there are still cases of domestic workers who are unaware of their rights and guarantees, or who, due to their socioeconomic condition, are forced to renounce them. Therefore, analyzing the law and jurisprudence in this regard is not only necessary but also a duty and a historical debt, so as not to continue perpetuating this situation through silence and to materialize and enforce the conditions and rights achieved through the dissemination of information on the legal mechanisms available.Ítem El centro de escucha laboral con orientación preventiva y predictiva y su influencia en el mejoramiento de la salud mental de la población laboral formal en Armenia(Universidad EAFIT, 2023) Carreño Osorio, Carolina; Vargas Sáenz, Mario EnriqueThe present work seeks to determine the contribution of a labor listening center with preventive and predictive orientation in the improvement of the mental health of the formal labor population in the municipality of Armenia, Quindío. The target population is people working in the municipality of Armenia in the formal sector, who are in the age range of 18 to 62 years. The problem of the research arises from the worrying current state of the mental health of the labor population of the municipality of Armenia, since it has been shown that occupational diseases related to mental health have been increasing in recent years.. In addition, the inefficiency of the health system in the provision of social services aimed at the formal labor population that can contribute to the improvement of their mental health is added. For the research, the mixed method was applied. As a first step, the targeted population was characterized, from a demographic, business and mental approach. Then, the key actors of the municipality of Armenia and their position on a proposal to improve the mental health of the formal labor population were recognized. Finally, the operational plan for the creation and operation of the labor listening center is designed, which is recognized as a community device. To meet the established objectives, research was carried out to establish a framework for study and analysis of the different dimensions of labor well-being that must be considered when the work mechanism includes teleworking, whether in full-time or part-time mode. Once a clear conceptual framework was defined, a study was carried out with a quantitative approach through a survey that would allow collecting information on the perception of an established population group regarding the variables that would analyze the 9 dimensions for an evaluation model of the impact of the teleworking in occupational well-being. People from different types of companies within the ICT sector in Bogotá – Colombia participated in this survey. The results obtained through the analysis of the survey data made it possible to identify key aspects of the impact of teleworking on work well-being, such as some aspects being more relevant for women and men, and where they stand out as aspects with greater alteration due to the teleworking, interpersonal relationships, work overload and occupational illnesses. Methodology: Qualitative, phenomenological and categorical study. Semi structure interviews where applied to seven women and three men from the city of Medellin during the first semester of 2019. With the obtained data was conducted a reflexive analysis. Results: In general, the work experiences allowed to this group of retirees a personal and professional growth and therefore described and perceived as positive. It is possible that a physical and/or mental wear, had occurred since the work experiences included sometimes negative situations and emotions. The participants perceived their quality of life as good, highlighting the importance of health and the value their work experiences gave to their current quality of life. Conclusion: The work experiences allowed this group of retirees be conscience about the jobs they enjoy and the work environments that potentiate their abilities. These participants reflected on the role their perception had on their work experiences specially related to their current health discomforts.Ítem Relación jurídica sobre el acoso laboral y la culpa patronal en torno a las enfermedades mentales(Universidad EAFIT, 2023) Marín Zapata, Simón Jairo; Piedrahita Vargas, CamiloMental illnesses as a consequence of labor harassment are protected by the Colombian legal system; likewise, the WHO has established several guidelines to understand mental health as a state of well-being of individuals that allows their development in the community. In accordance with, the Political Constitution of Colombia guarantees the right to health of all the inhabitants of the Colombian territory. For this reason, this essay addresses elements that allow identifying the circumstances that arise in the context of labor relations that generate mental illnesses in workers as a consequence. And we try to elucidate the reasons why these mental illnesses are effectively configured as a result of labor harassment and employer's fault; rather than from situations that are more related to the and employer's guilt, rather than situations and circumstances that affect the individual in everyday life. The above, from various sources that have their origin in the World Health Organization, the Diagnostic and Statistical Manual of Mental Disorders, the International Labor Organization, the Ministry of Labor, the Political Constitution of Colombia, the Colombian Labor Code, Law 1010 of 2006 on Labor Harassment, Decree 1295 of 1994, national jurisprudence and doctrinal elaborations of various authors. In this way, a qualitative study is carried out to identify the factual circumstances from empirical elements, in order to perform an analysis of the psychological damage in terms of disorders and pathologies that arise in relation to work and more specifically to harassment at work.
