Enfoques evolutivos en el derecho : la intersección entre derecho, ciencias evolutivas y la teoría de sistemas, y una revisión crítica al concepto de "estado de naturaleza" en el contractualismo social clásico
(Universidad EAFIT, 2025-11) Lora Restrepo, Santiago; Ramírez Giraldo, Vicente Jaime
A notable epistemological disconnection from evolutionary sciences persists within the Latin American legal tradition, relegating their influence on marginal, primarily technical roles. This article challenges this disconnection by arguing for an approach to law informed by evolutionary sciences—specifically, Evolutionary Analysis in Law (EAL)—as a key interdisciplinary paradigm. It posits that EAL operates across two complementary dimensions: a micro dimension, which employs behavioral biology, evolutionary anthropology, and primatology to elucidate legally relevant phenomena; and a macro dimension, which, in dialogue with autopoietic systems theory (Luhmann, Teubner), conceives the legal system as a structure that evolves in response to selective pressures from its environment. The article concludes by asserting that law is not merely an extraordinary counter-natural artifice, but rather an emerging, evolving technology—a manifestation of a tool shared by various social species—rendering its analysis from an evolutionary perspective highly relevant. Furthermore, it maintains that it is possible to speak of a contemporary concept of human nature (evolutionarily informed) that presents similarities as well as significant distinctions from the ideas proposed by Hobbes, Locke, and Rousseau.
