    This undergraduate thesis examines the persistent gap between the judicial recognition of comprehensive health care and the effective access to gender-affirming medical services for trans persons in Colombia, within the framework of the General Health Social Security System. Despite the robust jurisprudence of the Constitutional Court protecting the rights to health, gender identity, and free development of personality, administrative barriers, discrimination, and the absence of unified medical protocols hinder the materialization of these rights. Through a case study of the “Griselda Giraldo” file, processed by the Legal Clinic of EAFIT University, this research identifies the reasons why judicial protection (constitutional protection action or 'tutela' action) often proves insufficient to ensure effective access to the necessary procedures. The study analyzes relevant case law, gender-affirming procedures and their connection with fundamental rights, as well as the problematic implications of this gap for the health and dignity of trans persons.

    Historically, major economic processes have been accompanied by the improvement of the health conditions of the population, thus preponderating Health as a fundamental right of human beings in the economic development of communities and territories, playing an important role in financial growth, social and human development in different countries. (García-Rodríguez, 2017) The reasons why the purchase of health service provider entities by large international companies (Quirónsalud, Lenus Capital Partners, Patria Investments, Fresenius Medical Care, Steward Health Care and Auna) have increased allow us to identify the potential economic impact of the capital investment, the revitalization of the economy and expansion of the labor supply in the sector, likewise, a very significant social impact is evident with the opening of new health services, generating greater accessibility and opportunity to subspecialties that previously did not exist in the different territories. In this context, the objective of this literature review article is to explore the growth of Foreign Direct Investments in the Colombian Social Security System. The methodology used to prepare this article was fundamentally based on a review of fifty documents, which are classified into academic, technical and opinion literature. The results of the article reveal that Foreign Direct Investment (FDI) in the General Health Social Security System in Colombia allowed the expansion of health services in the country, validating this in the acquisition by investors of advanced medical equipment. , implementation of innovative technologies, training and high technical levels of health personnel, directly impacting patient-centered care.
