    Aspectos jurídicos relevantes sobre los Marketplace en Colombia

    This research paper investigates the impact that Marketplace-type digital platforms have had on the purchase and sale of goods and services nationally and internationally. It is intended to make a tour of its delimitation, definitions, actors, scope in which they operate and jurisprudence and pronouncements of the Superintendence of Industry and Commerce about digital platforms that already have a normative regulation in our country. All of the above, together with the non-existent regulation of Marketplaces in Colombia, leads us to ask ourselves the vortex question of the Research work that summons us: is there currently a need in Colombia for a new legal figure that better adapts to the concept and business model of the Marketplace?

    The present document will study the incursion of the collaborative economy in the passenger transport in Colombia, and if this form of competitions is a way of an unfair competition. Platforms like Uber, Cabify and Didi are competing in a sector of the economy monopolized by taxis who are subjected to some special rules they must comply with in order to operate in Colombia. Which is why it is important the debate as to whether Uber, Cabify or Didi should be benefited with the principle of freedom to provide services and innovation or whether they are included in the transport sector and should abide by the rules the taxis have to work with.

    Desafíos regulatorios de las plataformas digitales de transporte en Colombia en materia laboral : un análisis integral desde las diversas modalidades contractuales

    Despite the undeniable impact of digital transportation platforms in global economies, they are facing a regulatory dilemma due to the regulatory void and absence of clear rules that regulate the relationship between the two sides of the relationship (platform owners and transporters). This situation becomes especially evident in contexts such as the Colombian context, where so far there is no legal framework that specifically regulates such interactions. The reason for the above could be attributed to the fact that the transportation services offered through these platforms seem to escape the traditional categories of employment contract or personal service provision. This presents a considerable challenge when defining the type of relationship existing between the parties involved, a crucial aspect to determine which would be the conditions that guarantee the protection of the rights of these collaborators. In this order of ideas, this study will analyze, first, the panorama of digital transportation platforms in Colombia, that is, their functioning and operation in the Colombian market, as well as the contractual figures that emerge from them or that may be applicable; the positions of the different Government institutions regarding their regulation; the considerations made by international entities and the developments on these platforms in countries such as Spain, the United States and Chile; the presentation of the perception of the people who provide their services through these platforms and, finally, the conclusions resulting from the analysis will be presented, as well as the proposals to solve the problems mentioned.

    In this document it was realized a path through the evolution of the term Fintech from its origins in the XIX century -- The Fintech ecosystem was analyzed where the academy recognized the components that had some influence such as the technological developments, governments, traditional financial entities and financial customers -- These factors presented important changes in the first decade of the XXI century that generated its development -- They were e-finance, social network, artificial intelligence and big data -- It was found that millennial’s demographic characteristics adjust to services offer by fintech companies -- It was described the strengths and weaknesses of the peer-to-peer business model, which has had a strong effect in the financial industry -- Finally, it was concluded how the repercussions of the Subprime Crisis in 2007 in the United States encouraged the development of Fintech and the main task these companies should focus is the confidence and security of their services and products to continue getting more clients and competing with banks

    Infracción de derechos marcarios en el Metaverso

    Due to the increased growth of technology, the internet, and the metaverse has created significant legal challenges, particularly regarding the protection of intellectual property rights. This paper explores the complexities surrounding trademark infringement in the metaverse environment, focusing on the role of artificial intelligence (AI) in the creation and commercialization of digital goods. In the decentralized and global nature of the metaverse, traditional legal frameworks struggle to address new forms of protection, breaking with principles such as territoriality and specialty, and in consequence new forms of infringement, where users may intentionally or unintentionally violate intellectual property rights. A critical issue is determining the liability of infringers in these virtual environments. This research investigates how existing intellectual property laws, particularly in Colombia, can be applied to protect registered trademarks in the metaverse. By analyzing the legal gaps in current legislation, this monograph provides insight into how AI-generated digital assets challenge conventional legal frameworks. It also evaluates the impact of trademark violations on brand value and the necessity of developing new legal mechanisms to safeguard trademarks in virtual spaces.

    Plan de posicionamiento de marca para BOREAL

    Every day, the competition in the Colombian market, is growing, making the brand positioning a harder challenge, but if a right study to know what the target of the brand BOREAL wants to consume on social media, it will be easier to create a branding plan in which the communication will be way more effective, showcasing the best qualities of the brand and not only creating a great top of mind, but also a remarkable top of heart. To achieve this, an exploratory study with a qualitative focus has been made, in which for starters, a review of the literature has been made studying what some of the most remarkable marketing gurus had said in the past such as Aaker, Al Ries and Godin. Following this, eight interviews were made to know what the customers and followers of BOREAL are looking for in the content they consume on social media and also what they look for in a brand in general and finally, a case study of two brands with a national and global focus that have positioned their brand effectively and have created a great community in their social media platform. The results obtained from the study, were to fulfill the following goals: (A) know what the behavior patterns are for the target in social media, (B) identify the benchmark and strategies to reply and finally (C) evaluate the trends in communication and social media marketing. The goals set in this study, allowed the following results to be found: the frequency in which the brand need to post in social media to stay relevant and not saturate with unwanted publications, the content that need to be created in order to accompany the products and create a deeper connection with the follower, and finally, if the brand need to use strategies such as influencer marketing to reach a wider audience or if it needs to look for a more organic approach.

    Retos y particularidades del Impuesto de Industria y Comercio (ICA) en actividades de creación de contenido para adultos en el Distrito de Medellín

    This study examines the Industry and Commerce Tax (ICA) and its application with respect to the creation of adult digital content in Medellín. It will analyze how digital platforms such as OnlyFans and webcam modeling services have become significant economic factors in the municipality of Medellín. The research addresses the nature of this economic activity and the tax regulations applicable in Colombia, with a particular focus on Medellin. In addition, the challenges faced by ICA taxation will be explored, identifying the difficulties for the effective collection of this tax in relation to these activities. The study considers the complexities introduced by the digitization and global export of adult content, highlighting specific problems in the implementation of the ICA.

    El trabajo en la era digital : un reto al positivismo jurídico

    In this work, a detailed study is proposed on the challenges about “digital job-generating platforms” in Colombia in the midst of the fourth industrial revolution. To this end, we review what they are about and how we can rate them. Secondly, we define the essential elements of the employment contract and their related regulatory framework. In the third place, we are presenting you some contracting modalities that are used in an alternative way in Colombia and we identified the new legal problems originated as a result of the digitization of work, in contrast to the bills that are being advanced and the national and international jurisprudence regarding the future of this kind of work.
