It is shown that EAL defends a system of strict liability for those cases (and the reasons for it), with the main goal of reducing accidents and the costs that they imply for society. On the other hand, the main critiques to EAL and its application in the topic developed are exposed, defending at the same time why they don´t affect the conclusion that it would still be convenient to apply in that type of cases its recommendation of making strict the system of liability. After this, the jurisprudential development thas has led to the current strict liability system for dangerous activities in Colombia is shown, and it is made evident the necessity or importance that the Supreme Court of Justice and the Congress take into account the postulates of EAL in order to consolidate once and for all a rule of strict liability for the cases of dangerous activities.Ítem Análisis económico del mecanismo de respuesta de la demanda en el sector eléctrico colombiano(Universidad EAFIT, 2017-07-01) García, John J.; Gutierrez, Alejandro; Vargas Tobón, Luisa; Velasquez, Hermilson; jgarcia@eafit.edu.co; lvargas9@eafit.edu.co; evelas@eafit.edu.coThis paper is based upon the PJM market Demand Response Program, which it is considered as one of the most successful DR mechanisms over the world. Based on its design, the economic impact that could be achieve if a similar DR program were implemented in the Colombian market was determined. A DR program has been proposed that could achieve 600 MW of capacity in a mature stage. When its impact was took into account in the market price, it was found that for 2015 its impact in the DR dispatch hours could achieve lowering spot price in around 30%. The use of incentives is then of great importance, since through them, influence is generated in executives' decisions conditioned on results. The purpose of this paper is to describe the executive compensation in the case of a company in Colombia, comparing with industry peers in the US. The conclusion reached is that, effectively, the remuneration and incentives of the executives are a useful tool to align their interests with the shareholders. Specifically, it is hypothesized that belonging to the subsidized system increases the probability of belonging to the informal sector. To test this, linear probability, logit and probit models are used along with a LASSO model for the selection of variables. It was found that belonging to the subsidized regime is associated with a 13 pp higher probability of being informal. However, to adequately reflect the dual causal relationship between the variables of interest, a bivariate probit model is proposed. The results allow us to conclude the existence of a significant relationship between informality and the health system.
