    What is intended in this writing is to demonstrate the gap that exists in Colombian legislation regarding the obligations that arise to the consumer during the exercise of his right of withdrawal towards the producer or supplier that initially marketed a good or service. Such gap generates an inapplication of the principle of equality against the obligations imposed to consumers and suppliers by the Law 1480 of 2011 (current Consumer Statute). This document is important because at the time, controversies are evident between consumers and suppliers in relation to determining the term of fulfillment of the obligation on the part of the consumer to return - to the producer or supplier - the product (good or service) purchased initially, once the right to retract has been exercised, the producer or supplier is under the obligation to return the total value paid by the consumer for the purchase of the product within the following thirty (30) calendar days from the moment in which the consumer has exercised his right of withdrawal, without counting if the producer or supplier -before the return of the money- had received back the product initially purchased by the consumer.

    The rules explaining state liability born from terrorist attacks perpetrated by non-state agents seem to be far from conceptually clear. Although the regime for subjective liability and its application seem to be non-disputed, something different occurs regarding the state’s strict liability by means of “exceptional risk”. Despite the efforts made by the Third Section of the Council of State Plenary in order to depurate the Council’s position regarding this matter, the dissidence among some magistrates in recent decisions has increased the legal uncertainty. However, some steps have been taken to consolidate the concepts and notions that support the application of strict liability linked to terrorist attacks, giving answers and creating new questions as well. That is the case of the ruling of June 4th, 2019, where the Council of State analyzed the exceptional risk regime and its pertinence in this matter. In this scenario, this article aims at explaining briefly the legal foundations built in Colombia to justify state’s strict liability due to terrorist attacks. Furthermore, we will examine critically the most recent rulings by the Council of State that are relevant, whether politically or legally, in this matter. Finally, we will conclude the conditions of application of the strict liability regime due to terrorist attacks and the doubts that remain.

    De las personas en situación de discapacidad y su capacidad legal a la luz del Código Civil, Ley 1306 De 2009 y Ley 1996 De 2019

    This work has two main objectives: the first is to make a compilation of Colombian regulations on how protection has evolved in relation to the principle of equality and the social recognition of capacity. To this end, a study of the Colombian Civil Code, Law 1306 of 2009 and Law 1996 of 2019 will be carried out, from approaches based on the social, judicial and constitutional spheres. The second is to present the violation of the fundamental right of protection, a definition of people with disabilities with their classifications and mention the different normative supports on disability in Colombia, emphasizing Law 1306 of 2009 and Law 1996 of 2019 with their respective derogations and implications.

    International Organizations such as UN, ILO and OCDE have extended the spectrum that we’ve been studying and analyzing the gender gap with, highlighting the fact that there is still a huge difference regarding the remuneration that men and women get under the same circumstances of mode, time and place; difference that, mostly, has been attributed to the discrimination that women have been a target and victims traditionally. Thus, EPIC Coalition has emerged with the goal of eradicate wage inequality trough the entailment of different actors and the provision of legal and methodological tools to such end, accomplishing a bigger impact by incorporating organizations of international dimension that, in a long term, might also embody binding guidelines and reinforces the commitment of the States and their own actors to end the Gender Gap.

    Taking as a starting point to begging, for one side some lawsuits that many citizens have been requesting the unilateral divorce due to different arguments, even though this have been solved by the Constitutional Colombian Court always in a negative way on its judgments C-394 of 2017, C-134 of 2019, C-135 of 2019 and C-589 of 2019. On the other hand, the last laws projects that The Colombian Republic Congress has been processed to admit the “free divorce” in Colombia, the first of them was rejected and the other one, it has been on debate. This thesis proposes to make a comparative law study between Argentina and Spain with the aim of exploring the precedents, the implementation, and the negative and positive legal effects that unilateral divorce has caused in their legislation.
