This notion completely forgets that the rights to honor, privacy and human dignity serve as insurmountable limits to this right. The idea of criminal intervention as the first defense mechanism against the offenses that freedom of expression can generate has been ineffective in today's society. Various constitutional courts offer mechanisms to solve the latent conflict between these blocks of fundamental rights. It is undeniable that the rise of social networks completely changed the way we communicate. Today, we are one click away to find out what is happening in our country and the world. Social networks are characterized by the immediacy of information, since they lack of censorship and respect for the other; but they play a prominent role in the search for truth. For this, it will be necessary at first to contextualize the right to privacy and its protection in the legal system, as well as the regulation of the right to evidence, its characteristics, and its limits. This from the perspective of the new technologies that have broken into today's society through the internet, social networks, applications, databases, among others, which, although they represent new evidential possibilities, also carry a greater risk of violation of the right to privacy. In a second stage, the interference of new technologies in civil and criminal proceedings will be analyzed, determining how these can be legitimately incorporated into judicial processes. In addition, taking into account the potential risk that these new technologies imply against the right to privacy, it will also be necessary to study the availability of this right, as well as the limits and protection mechanisms established in the Colombian legal system, addressing issues of special concern. special interest such as the investigative powers of the prosecution, the right to privacy of persons deprived of liberty, and unlawful evidence. In this regard, this right allows negative data to be present in a database only for a limited and specified period of time, in order to safeguard the right to privacy, good name and dignity of the data subject, in accordance with this, the impact of technological advances in the application of the right to be forgotten will be analyzed. Based on the foregoing, this document will focus on the study of Colombian jurisprudence, making comparisons with international regulations.
