This investigation aims to define if the regulation in those legal systems takes a multiculturalist or feminist approach, based on the assumption that the practice entails a conflict between the rights of self-determination and cultural identity of the communities that practice it and the fundamental right of physical and mental integrity of those girls and women that have experienced female genital mutilation.Ítem La acumulación de la indemnización a cargo del responsable con las prestaciones de las aseguradoras de riesgos laborales : un análisis crítico(Universidad EAFIT, 2021) Urquijo Maya, Simón; Herrera Malo, Nicolás Enrique; Baena Aramburo, FelisaOnce an employee suffers a harm, two compensation obligations may arise: 1) the obligation from the employer or from a third party to compensate the employee, and 2) the victim's right to claim compensation from the occupational risk insurer. This situation has led practicing attorneys, as well as academics and judges, to wonder whether our legal system allows for the employee to claim both payments. In this text we analyze the approaches that the judges and academics have taken in this regard, to identify criteria that allow to find the answer to that question, both for the case in which the employer is responsible and for the case where the person responsible is a third party. These two scenarios have their particularities and therefore need differentiated analyses. However, this right has not been fully guaranteed to those subjects who come to the ordinary jurisdiction in search of an economic support, which guarantees a monthly income that can supply the basic needs of people who are unable to continue working, hence, there have been numerous cases in which despite not being a fundamental right in principle, and having its own judicial mechanisms to dispute it through ordinary channels, the jurisprudence of the Constitutional Court has enabled the origin of the action of protection in some cases. In this dissertation we analize the contribution of the social integration programme and the factors which reduce the emigrants’ integration with the purpose to seek for special cares and to improve this programme relying on a future growth. Some of the specific factors on which this survey was centred were: the attendance of the emigrants at the workshops set then by the programme; the knowledge of the Italian language; the knowledge of the legal rules of law and of their importance for the social integration of all the Peruvian emigrants. In the prospects of the social running, this survey aims to determine the probabilities of the results and the prospects to improve our intervention to optimize the attention towards the real aim and to give strength to a programme which can contribute and increase the social policy of the Italian government with reference to the established rules and procedures. The catholic church will do as much it can to share its work and experience with the emigrants. The analysis which results from this survey allows us to establish that the work done by the “Cura Pastoral Latino Americana” through its programme “Social Integration” has obtained important goals. Nevertheless it would be a good thing to obtain a bigger financial backing and to create synergies with the people living in Genova consolidating the work we are doing.Ítem Análisis jurisprudencial y normativo del derecho a morir dignamente en Colombia a través de la eutanasia, en contraste con el delito de homicidio por piedad, tipificado en el artículo 106 del Código Penal Colombiano(Universidad EAFIT, 2021) Almánzar Agudelo, Angélica María; Naranjo Serna, SebastiánCurrently, in the Colombian legal system there is a normative vacuum void in relation to the regularization of the right to a dignified death by means of euthanasia, and, consequently, when the crime of mercy killing is committed. This is given by, when the legal requirements of euthanasia are not met, the question arises as to whether this leads to the commission of the crime of mercy killing or not. Over time, there have been various discussions in response to this questioning, because despite the fact this subject has been dealt with for more than 20 years by the Courts, the Congress has been repeatedly exhorted to regulate the subject, without having done it to this day. On July 1, 2021, the Ministry of Health and Social Protection established in the Resolution number 971 the procedure for receiving, processing, and reporting euthanasia requests, as well as the guidelines to make effective the right of dying with dignity by means the euthanasia. The foregoing was thus established, taking into account what was raised by Constitutional Court in the jurisprudence, where it has repeatedly established certain criteria or parameters to guarantee said right. Days after the Resolution was published, the Constitutional Court, based on Sentence C 233 of 2021, issued statement 27 of July 22, 2021, that extends euthanasia for non-terminal patients. With this, it is understood that the interpretation of euthanasia, and consequently, of the criminal type of mercy killing changes. Because of the above, this paper will focus on trying to answer questions such as: What are the requirements for applying euthanasia in Colombia? When is the crime of mercy killing, established in the article 106 of the Colombian Penal Code, committed? Based on the most recent ruling of the Court, will there be legal security in the Colombian legal system, regarding an issue that still lacks any regulation by the Congress? among others.Ítem Análisis sobre la competencia del sistema interamericano para conocer de los casos previamente resueltos por la Jurisdicción Especial para la Paz(Universidad EAFIT, 2019) Duque Vélez, Mariana; González Cifuentes, Sara; Toro Valencia, José AlbertoTransitional justice is a normative concept created under international and national law that provides temporary regulations to achieve a peaceful transition from war to peace. Under the Colombian government Peace Agreement with the FARC-EP the Special Jurisdiction for Peace is the transitional justice mechanism created under the observance of these parameters and with a restorative justice approach in favor of the victims. The Inter-American Human Rights System is the regional mechanism responsible for the promotion and protection of human rights in the continent. Considering the recent entry into force of the Special Jurisdiction for Peace, it is important to analyze the eventual competence that the Inter-American Human Rights System would have in the cases previously resolved by this court. However, the case law of Inter-American Court of Human Rights, indicated that, although imprescriptibility clearly operates in criminal actions, it is also possible that this guarantee of imprescriptibility applies to other actions such as those aimed at suing the State. The most important is to safeguard the integral reparation right, regardless of the action that is initiated, when we are faced with human rights violations.
