Through the study of specific cases, it examines how gender issues have been addressed in these processes and the impact these decisions have had on the outcomes, both for the victims and for those disciplined. The analysis reveals that, although the gender approach is theoretically a fundamental component of institutional policies, its practical application has been insufficient due to various factors. Among these, the significant delays in resolving disciplinary processes, institutional inaction in response to initial reports of harassment or gender-based violence, and the lack of adequate and continuous support for victims stand out. Additionally, it is observed that the professionals responsible for these cases do not always receive proper training in gender issues, which limits their ability to address these situations with the necessary sensitivity. As proposals for improvement, strategies are suggested to significantly reduce process times, ensure prompt and effective responses to complaints, strengthen support for victims, implement continuous training in gender issues, and establish an observatory to evaluate the effectiveness of these policies. Although existing regulations seek to balance contractual responsibilities, challenges remain that undermine fairness in contractual relationships. From a philosophical standpoint, justice and contractual ethics emerge as key elements for achieving a more equitable risk allocation in strategic sectors. The study concludes that integrating legal mechanisms with ethical principles is crucial to enhancing sustainability and fairness in contractual relations.Publicación La figura del administrador de hecho en el derecho colombiano : retos de aplicación en las acciones de responsabilidad(Universidad EAFIT, 2025) Villegas Brandani, Simón; González Jaramillo, José LuisThis thesis examines the figure of the de facto administrator in Colombian corporate law, based on the liability regime established in Laws 222 of 1995 and 1258 of 2008. A de facto administrator is a person who, without holding a formal position, carries out positive acts of management, direction, or administration within a company, and thus assumes the same duties and responsibilities as a formally appointed administrator. The study explores the key duties that govern their conduct—such as good faith, loyalty, and diligence—and how breaches of these duties may give rise to legal actions for damages caused. The research addresses the two main liability actions: the social action, aimed at compensating the company for harm to its assets, and the individual action, which allows shareholders or third parties to claim for personal damages. It also highlights the evidentiary challenges involved in obtaining a judicial declaration of de facto administration, and in proving a causal link between the breach of duties and the resulting harm. In addition, the work compares the Colombian approach with similar figures in other jurisdictions, such as Spain, France, and common law systems, emphasizing key differences—especially regarding the continuity of conduct and the level of control exercised. Diana MaríaIn this work, the exclusions in insurance contracts are studied, which are clauses that delimit the risks indicating those that are not covered by the policy. They are necessary to protect insurers from excessively burdensome risks and for the insured to know the scope of the coverage contracted. Although their importance is recognized, it has been established that for exclusion clauses to be valid, they must be included in the contract, be clear, reasonable, and must not distort the main purpose of the insurance. Doctrine and jurisprudence have agreed that they must be interpreted restrictively and in favor of the insured, especially when they are in a position of inferiority. This is why insurers have information obligations at the time of contracting the insurance. Despite their importance, the scope and validity of the exclusions are discussed, raising the question of whether exclusions can lead to contractual imbalance? To answer this, we will study both doctrinal analyses and the positions of the Supreme Court of Justice that refer to the consequences that a poorly conceived exclusion clause may have, to determine whether or not they can create a contractual imbalance between the parties, even being classified as abusive clauses punishable by ineffectiveness. In conclusion, the drafting of exclusion clauses is a complex matter that requires a balance between the protection of insurers and the rights of the insured.
