Ítem Cosa juzgada en lo civil(Bogotá : Imprenta de La Luz, 1909) Vizcaíno, Francisco S.Publicación Enfoque de género en los procesos disciplinarios de los profesores de la Universidad de Antioquia (2017-2023)(Universidad EAFIT, 2025) Osorio Madrid, Daniel; Montoya Restrepo, Nataly; Universidad de AntioquiaThis research analyzes the implementation of the gender approach in the disciplinary processes at the University of Antioquia during the period 2017-2023. Through the study of specific cases, it examines how gender issues have been addressed in these processes and the impact these decisions have had on the outcomes, both for the victims and for those disciplined. The analysis reveals that, although the gender approach is theoretically a fundamental component of institutional policies, its practical application has been insufficient due to various factors. Among these, the significant delays in resolving disciplinary processes, institutional inaction in response to initial reports of harassment or gender-based violence, and the lack of adequate and continuous support for victims stand out. Additionally, it is observed that the professionals responsible for these cases do not always receive proper training in gender issues, which limits their ability to address these situations with the necessary sensitivity. As proposals for improvement, strategies are suggested to significantly reduce process times, ensure prompt and effective responses to complaints, strengthen support for victims, implement continuous training in gender issues, and establish an observatory to evaluate the effectiveness of these policies. These measures aim to create a more equitable and gender-violence-free university environment.Publicación Hacia un nuevo régimen de la responsabilidad causada por los perros de manejo especial(Universidad EAFIT, 2025) Vergara Montoya, Susana; González Jaramillo, José LuisThe main object of this article is to analyze if the liability derived from a special handling dog that serves no purpose for guarding nor serving a property can be considered as subjective liability, given that Colombian law imposes an objective liability regime, under article 2354 of the Civil Code. Additionally, we tend to study the possible expansion of exceptions to extracontractual civil liability in those scenarios where the guardian or the keeper of the dog meets all the requirements for the ownership of the canine.Publicación Infancias marginadas e injusticia estructural : una mirada crítica desde la filosofía del derecho a las medidas de justicia distributiva que previenen el reclutamiento forzado de menores en Colombia(Universidad EAFIT, 2026-02-18) Álvarez Quintero, Narly Julieth; Gaviria Mira, JuliánThe forced recruitment of minors in Colombia constitutes one of the most serious violations of human rights and international humanitarian law, as it involves the participation of children and adolescents in illegal armed groups through coercion, deception, or other forms of co-optation. Despite the existence of a robust regulatory framework and international commitments made by the State, this practice persists and even increased during 2024. The objective is to identify whether the distributive justice measures implemented in the Colombian legal system are sufficient to prevent this phenomenon. Using a qualitative methodology based on the analysis of documentary sources from the perspective of legal philosophy, the results offer a critical reflection that urges the Colombian State to reorient its efforts towards transforming the structural conditions that perpetuate the vulnerability and exposure of minors to armed actors.Publicación Inteligencia Artificial en la formación jurídica en Colombia : estudio de caso en la Universidad EAFIT(Universidad EAFIT, 2025) Rojas Alba, Jaksenn Nicoll; Múnera Arango, Juan Sebastián; Sánchez Vásquez, CarolinaThe document examines the impact of AI on legal education, focusing on EAFIT's School of Law. Through a mixed-methods approach, including documentary analysis and faculty surveys, it reveals that AI enhances access to legal information but is used sporadically and poses risks such as superficial learning and diminished critical thinking. The lack of specific regulations in Colombia creates uncertainty, despite institutional initiatives. Recommendations include training faculty and students, establishing ethical policies, and ensuring equity to leverage AI without compromising educational quality.Publicación La buena fe en el derecho privado colombiano : análisis de la figura en el siglo XXI(Universidad EAFIT, 2025) Agudelo Jaramillo, María Camila; Tobón Vergara, Jorge AlejandroPublicación La distribución de riesgos en los contratos EPC en Colombia : aproximación jurídica y filosófica al equilibrio contractual(Universidad EAFIT, 2025) Patiño Giraldo, Mariana; Castaño Echeverri, LauraThis study examines risk allocation in EPC contracts in Colombia, focusing on its legal and philosophical implications. Based on the current regulatory framework, it addresses the principles governing risk distribution and their connection to concepts such as force majeure, the hardship theory, and redhibitory defects. Although existing regulations seek to balance contractual responsibilities, challenges remain that undermine fairness in contractual relationships. From a philosophical standpoint, justice and contractual ethics emerge as key elements for achieving a more equitable risk allocation in strategic sectors. The study concludes that integrating legal mechanisms with ethical principles is crucial to enhancing sustainability and fairness in contractual relations.Publicación La figura del administrador de hecho en el derecho colombiano : retos de aplicación en las acciones de responsabilidad(Universidad EAFIT, 2025) Villegas Brandani, Simón; González Jaramillo, José LuisThis thesis examines the figure of the de facto administrator in Colombian corporate law, based on the liability regime established in Laws 222 of 1995 and 1258 of 2008. A de facto administrator is a person who, without holding a formal position, carries out positive acts of management, direction, or administration within a company, and thus assumes the same duties and responsibilities as a formally appointed administrator. The study explores the key duties that govern their conduct—such as good faith, loyalty, and diligence—and how breaches of these duties may give rise to legal actions for damages caused. The research addresses the two main liability actions: the social action, aimed at compensating the company for harm to its assets, and the individual action, which allows shareholders or third parties to claim for personal damages. It also highlights the evidentiary challenges involved in obtaining a judicial declaration of de facto administration, and in proving a causal link between the breach of duties and the resulting harm. In addition, the work compares the Colombian approach with similar figures in other jurisdictions, such as Spain, France, and common law systems, emphasizing key differences—especially regarding the continuity of conduct and the level of control exercised. The paper concludes by proposing legal and statutory reforms to strengthen the application of this figure, ensuring both its effectiveness in protecting corporate interests and the legal certainty of those involved.Publicación La protección jurídica de la gastronomía tradicional en Colombia a través de la propiedad industrial : caso de estudio la Lechona Tolimense(Universidad EAFIT, 2025-11-14) Méndez Ortiz, María Catalina; Correa Márquez, María CamilaThis research analyzes the legal possibilities for protecting traditional Colombian cuisine, with an emphasis on the case study of “lechona tolimense” as a representative example of typical dishes in the country. The study provides a comprehensive analysis of the main applicable legal instruments, such as designation of origin (D.O.), trademarks in their various categories (collective, certification or country brand), and complementary figures such as the Colombian Gastronomic Seal and intangible cultural heritage. From a comparative law perspective, international mechanisms such as traditional specialties guaranteed (TSG) and geographical indications (GI) are also studied in order to identify good practices and strategies that can be replicated or adapted to the Colombian context. The analysis shows that, depending on the desired protection approach, Colombia has both industrial property and public law tools to support traditional gastronomic products and dishes. However, these concepts have been little explored and applied in relation to traditional cuisine, which limits their recognition, positioning, and preservation in national and international markets. It should also be noted that the protection of dishes should not be restricted solely to their name or designation through trademarks, but should also include the ancestral knowledge, techniques, and skills that determine their quality, identity, and cultural value. Finally, based on international experiences, it is proposed that Colombia should promote more robust initiatives to legally protect its gastronomic heritage, encouraging both the preservation of this knowledge and the local economic development and international positioning of national cuisine.Publicación La responsabilidad civil de las personas jurídicas de derecho privado en Colombia por el hecho de sus contratistas(Universidad EAFIT, 2020) Agudelo Valderrama, Juan Pablo; Gaviria Cardona, AlejandroPublicación La responsabilidad civil extracontractual frente al uso de DeepFakes : posibilidad de una respuesta interpretativa desde el derecho colombiano vigente(Universidad EAFIT, 2025-09-25) Ugarte Tapasco, Estefanía; Jung, Haein; Mejía Rico, EstebanDeepFake is an emerging technology that has great potential to cause harm to rights such as image, honor, or privacy, harms that could even materialize in economic damage. In Colombia there is no specific regulation addressing this phenomenon, which raises the following question: Under what liability regime could non-contractual civil liability be established for damages caused by the use of Deepfakes? This thesis examines the problem by considering the approaches adopted internationally and by identifying the mechanisms available under Colombia law for this purpose.Publicación Manual del abogado americano : tomo segundo / por D. Such contracts overlook key aspects like intellectual property and authorship, exposing creators to legal and economic vulnerability. The study aims to develop a contractual model that ensures equitable relations between creators and companies, safeguarding image and intellectual property rights while preventing abusive clauses. By proposing a clearer and fairer legal framework, this work contributes to strengthening the protection of digital creators and promoting a more transparent and sustainable digital ecosystem.Publicación ¿Proteger la identidad de género de las infancias y adolescencias? : un análisis jurídico del consentimiento informado de la reafirmación de género en menores de edad trans(Universidad EAFIT, 2025) Echeverri Parra, Juan Sebastián; Alzate Tobón, Laura DanielaThe present text aims to inform both lawyers and health professionals about the present legal framework of informed consent for trans minors. To achieve this end, the concept of “subject of law” in the context of minors, what it is to be trans, and finally informed consent as a legal institution for access to gender reaffirmation treatments are explored. The conclusions integrate the findings of each section, synthesizing the functioning of the current regulatory framework and key concepts.Publicación ¿Pueden las exclusiones del contrato de seguro llegar a generar desequilibrio contractual? Revisión de la doctrina y algunas sentencias de la Corte Suprema de Justicia(Universidad EAFIT, 2024) Castro ossa, Luis eduardo; Gómez M. Diana MaríaIn this work, the exclusions in insurance contracts are studied, which are clauses that delimit the risks indicating those that are not covered by the policy. They are necessary to protect insurers from excessively burdensome risks and for the insured to know the scope of the coverage contracted. Although their importance is recognized, it has been established that for exclusion clauses to be valid, they must be included in the contract, be clear, reasonable, and must not distort the main purpose of the insurance. Doctrine and jurisprudence have agreed that they must be interpreted restrictively and in favor of the insured, especially when they are in a position of inferiority. This is why insurers have information obligations at the time of contracting the insurance. Despite their importance, the scope and validity of the exclusions are discussed, raising the question of whether exclusions can lead to contractual imbalance? To answer this, we will study both doctrinal analyses and the positions of the Supreme Court of Justice that refer to the consequences that a poorly conceived exclusion clause may have, to determine whether or not they can create a contractual imbalance between the parties, even being classified as abusive clauses punishable by ineffectiveness. In conclusion, the drafting of exclusion clauses is a complex matter that requires a balance between the protection of insurers and the rights of the insured.
