For this purpose, the reader will initially find a study of the interpretative, jurisprudential and legal evolution in which some of the most representative sentences that highlight the most important information of the principle will be brought to collation and together with this, the direct implications of the current jurisprudence to the principle of reinforced labor stability in Colombia will be evidenced, in accordance with the specific contractual modalities of the labor relationship that concatenate with the object of study. In the following section, a specific analysis will be made from a specific type of employer, the temporary service companies, with the purpose of showing from one of the contractual parties how the impact of the figure is materialized, having clear that it is usual to study it from the "weak" contractual party, that is, the employee; but little is delved into the other side of the figure and the entity or subject that ultimately, is the one that ends up bearing the economic burden that brings with it the application of the figure. It will be important to analyze the temporary service companies in accordance with the figure, since this will not only allow the reader to have in mind the contracting modalities and particularities of the labor relationships in this type of companies, but also to show how, in a type of company designed in Colombia to cover temporary requirements according to Law 50 of 1990, its social purpose of providing "temporary" workers could be truncated and distorted, due to the specific application of the special protection. The case of a specific temporary services company will be taken as the object of study, where we will address different specific cases of reinforced labor stability currently present, seeking to resolve the prerogative of whether this type of labor contracting aimed at meeting specific requirements is affected by the principle of labor stability, in the sense of maintaining untouched labor relations whose contractual object is already fully executed, as a result of an alleged health condition that enables a special protection for the worker. As an objective of the specific intervention to the temporary services company, a legal concept will be issued in the sense of recommending the best course of action for the treatment and approach of the cases; concept that in turn will help the reader to draw a clear picture of the actuality of the figure and the impact of it, for both parties of the contractual relationship, according to real cases that allow adding to the research a field study. In the same sense, throughout the research work, the legal basis of the figure in Colombia and the jurisprudential development along with its essential characteristics will be reviewed, so that, once this has been exposed, the functioning of the application of the principle of reinforced stability in health and its particular characteristics will be analyzed. In this sense, some hypotheses are posed in response to some questions that we questioned throughout the development of this work, which are necessary for a comprehensive approach to the concepts and methodologies of treatment of the figure of reinforced stability in Colombia, aiming to provide the reader with conceptual and procedural foundations that allow applying what was studied in the research in the actual approach to the subject in our country. Finally, in the last section of this research, we will bring up some general conclusions to which we arrived at the culmination of this research, taking into account that these gather all the investigated and analyzed material, thus arriving at some general hypotheses that bring together the theoretical framework and the field work, giving as a whole, answer to the essential object of the research.Ítem Indemnización de perjuicios por conductas antisindicales : reflexiones a propósito de la sentencia SL-3597 de 2020(Universidad EAFIT, 2021) Castaño Vélez, Sofía; Piedrahíta Vargas, CamiloÍtem Industria de contenido para adultos : protección de derechos laborales, vacío jurídico que tiene esta modalidad de trabajo(Universidad EAFIT, 2023) Barth Mejía, Manuela; Gallego Valencia, Catalina; Múnera Posada, ArmandoThis monograph is based on the lack of labor protection for workers on virtual adult content platforms and webcam models, as well as the legal gaps in this modality. Throughout this, the existing jurisprudence on the subject in the last 4 years will be analyzed, based on the Constitutional Court's Milestone ruling ST-109 of 2021, in which important concepts for webcam models in a state of pregnancy are expanded and developed. In addition, it will go through international norms and principles to then land on the most specific contender for national regulations to end up locating ourselves in the analysis of the lack of protection of webcam models and workers of these platforms in Medellín. The work modalities that include broad and diverse activities will be identified, not only focused on sexual development on virtual adult content platforms, so that way an analogy can be achieved in the hiring models for greater labor protection without neglecting the minimum benefits for the employer.Ítem ¿Podrá la minería ser una locomotora de crecimiento y desarrollo para el país?(Universidad EAFIT, 2013) Palacios Valencia, Leonidas Andrés; Chanci Bedoya, Rubén Darío; Uribe De Correa, Beatriz AmparoLa administración actual tiene proyectado en el corto plazo ser parte de los países que sustentan su crecimiento y desarrollo con aportes significativos del sector minero, motivo por el cual esta administración designó a la minería como una de las locomotoras que jalonará el desarrollo y crecimiento del país, situación que nos motivó a realizar un análisis a través de este trabajo -- Para empezar mostraremos las características de la actividad minera en algunos países que sustentan su crecimiento y desarrollo en este sector, y que son modelo de crecimiento y desarrollo en sus continentes y a nivel mundial, como es el caso de Chile para Suramérica, Sudáfrica para África, Canadá para Norteamérica, Australia para Oceanía y China para Asia; incluso algunos de estos países son considerados potencias a nivel mundial -- Se toma como referencia a estos países, en donde la minería por muchos años ha sido una locomotora de desarrollo y crecimiento, para tener una idea de qué tan lejos o cerca estamos para que la minería en Colombia aporte de manera significativa al crecimiento de la calidad de vida de los colombianos -- En segundo lugar se hace un análisis de lo que ha significado la minería en Colombia, actividad que tradicionalmente se ha realizado desde épocas precolombinas en vastas zonas del territorio nacional, pero que desafortunadamente no han significado para estas regiones un mejoramiento en la calidad de vida de sus habitantes, antes por el contrario en la mayoría de estas zonas se manejan altos índices de pobreza, descomposición social y un grave deterioro ambiental -- Se llega a concluir que es inaudito que un país como Colombia, con un alto potencial minero, comparable con los países aquí analizados como potencias mundiales, muestre índices de calidad de vida tan bajos, que han llevado a un inconformismo generalizado y que recientemente se ha manifestado en continuas protestas de los diferentes sectores productivos del país -- La ausencia del Estado por varias décadas en las áreas mineras del país ha contribuido de manera significativa a las grandes problemáticas que aquejan en la actualidad a la actividad minera, la cual se caracteriza por ser realizada por pequeñas unidades productivas, en medio de la informalidad, con bajo conocimiento técnico, con bajo (por no decir nulo) acompañamiento técnico del Estado generando una actividad depredadora de los recursos naturales, con baja o nula proyección social, altamente vulnerable a la corrupción y a merced de los grupos armados al margen de la ley -- La combinación de todos estos problemas, denominados dentro de este trabajo problemas estructurales, trae como consecuencia una baja cultura minera en la población colombiana, a pesar de la alta tradición minera que existe en el país, que lleva a que se tenga una valoración errada de la minería moderna, tanto en las personas que tienen una relación directa con la minería, como en aquellas que están ajenas a esta actividad -- Todo esta problemática es analizada a través de este trabajo por los autores, los cuales ponen en duda que la minería pueda ser por lo menos en el corto plazo la locomotora que jalonará el desarrollo del país, como lo promueve la actual administraciónÍtem Sanciones impuestas por parte del Ministerio del Trabajo y el Servicio Nacional de Aprendizaje -SENA- a empresas privadas por el incumplimiento del pago de cuota obligatoria de aprendices(Universidad EAFIT, 2015) Cardona Rojas, Tatiana; Daza Fernández, Javier NicolásThe purpose of this research work is to provide a contribution to a country that has been characterized by its conflictive nature and that today more than ever demands the development of social, cultural, and legal capacities that allow it to generate sustainable, binding, and responsible solutions so that social dialogue, economic development and legal security can continue to be the basis of participative and inclusive democracy. To achieve the above, it has been chosen one of the many conflicts that occur permanently in Colombia and that by its nature has a direct impact on economic and social development of the country due to its effects on the economy and on the relations between employers and workers: the collective bargaining conflict. A detailed approach will be made to the genesis of the collective bargaining conflict, the legal regulation and specifically, one of the ways to solve it will be analyzed: the Labor Arbitration Tribunal (hereinafter TAL). The importance of these tribunals lies in the possibility of intervening in the solution of collective conflicts when the parties have not been able to do so directly; hence the interest in this figure to understand what is its real capacity to contribute to the solution of collective bargaining conflicts and what opportunities exist so that they can really generate more value to a subject that again I wish to highlight as vital for the social and economic progress of the country. When starting to research on the subject, it was quickly understood that it was not enough to understand the conflict from the normative, but it was necessary to study some elements of violence in Colombia to understand its conflict and how this has also permeated the labor field without giving too much space to the conflict because of what can be called aversion on the matter due to the bad experiences that the nation is living. Once the real capacity of conflicts to allow differences to be resolved shown, the concept will be brought to Colombian labor law and contrasted with what is understood simply as one of the stages of collective bargaining, which takes away from the conflict the natural, permanent, and necessary vision that is part of labor relations. Finally, we will come to the labor arbitration tribunals and analyze the scarce norms that regulate their competence and how the case law has developed the matter.
