    Technology has always been present in human life as a facilitator and optimizer of processes, including legal business. Since the creation of Bitcoin in 2009 and the consequent implementation of the Blockchain as an emerging technology based on chain approvals, multiple uses have been derived from it, whether for the creation of applications, efficiency in business models or processes, electronic payments, or the conclusion of smart contracts. However, the latter has been the object of analysis due to their particular importance and transcendence in how negotiations, agreements, pacts, or any relationship derive in a contract's conclusion. In this sense, from a legal perspective multiple challenges have been established regarding the regulation and adoption of smart contracts. So far, this topic continues to lack normativity due to the difficulty of the application of the current theory of legal business in relation to Smart Contracts. In the present investigation, a historical recount of some figures and/or elements that gave rise to the creation of the Smarts Contracts will be carried out. Therefore, a specific definition of concepts such as Bitcoin, Blockchain, and Ethereum, among others, will be made to understand the emergence of smart contracts and how they work. Likewise, the Smart Contract concept will be specified, and its usefulness and practical application will be determined. Additionally, a comparative study between these and traditional legal businesses will be carried out to observe, based on their legal nature, whether or not they meet the minimum requirements for a contract agreement to exist legally. On the other hand, this paper shall conduct a study of the current foreign regulations on Smart Contracts, in order to determine how they have been implemented within foreign legal systems. Likewise, the advantages and disadvantages that the implementation of this new contracting modality may bring will be identified. Finally, together with a comparative law analysis of some of the different international legal systems that enshrine the issue of smart contracts, this paper will determine the possible solutions for the implementation and regulation of smart contracts within the domestic legislation.

    Bitcoin & blockchain: ¿la criptomoneda y la tecnología que pueden transformar el mundo?

    The current economic development and our knowledge of financial markets increasingly face new challenges that drive the emergence of previously unimaginable initiatives, such as cryptocurrencies, particularly bitcoin, which arises as a way of transformation of the traditional forms of exchange, defined by the current financial system that undoubtedly must change. The purpose of this paper is to show how bitcoin and blockchain works, showing the potential that both concepts have from their different scopes (bitcoin as an investment asset, and blockchain as technology applicable in different industries); also, with the aim of understanding within the Colombian context how accepted is bitcoin as an option of exchange, the results of a survey made to different companies that consider this cryptocurrency to be a valid payment option are presented, identifying which were their motivators.

    Bitcoin, una mirada desde la dinámica de sistemas

    Una criptomoneda o criptoactivo, es un medio digital de intercambio que utiliza criptografía para asegurar las transacciones, controlar la creación de unidades adicionales y verificar la transferencia de activos usando tecnologías de registro público descentralizado [12]. Seguidamente, en este proyecto se estudia la primera criptomoneda en operar, el Bitcoin. Por lo que, con base en la dinámica de sistemas se busca entender la relación existente entre 3 variables fundamentales de esta economía: la generación de monedas, la tasa de Hash, las ganancias asociadas a la minería y el impacto medioambiental de la red. Por último, establecer dicha relación permitirá obtener una visión general del Bitcoin básico y su funcionamiento. De manera que, se puedan proponer políticas y/o escenarios posibles que permitan una mejor toma de decisiones para la permanencia y adhesión de nuevos usuarios y, el crecimiento en el mercado de la moneda.

    Los criptoactivos como objeto de delito y su necesidad de regulación para restaurar la seguridad jurídica y la sociabilidad económica

    The present work has the purpose of analyzing the possible creation of a legal matrix or a legal framework regarding the use of cryptocurrencies in Colombia. Given the growing importance and recognition that these currencies have received over the time, the place where it stands nowadays, the undeniable immersion in the financial world and the large amount of transactions happening, it is necessary to identify the important elements and the possibility of including them in the colombian legal system, likewise, with the aim of reducing or, at least, controlling, the implications of these virtual currencies in the commission of crimes like money laundering and financing of terrorism. This research work is structured in five chapters: in the first one, the general aspects of cryptocurrencies are presented, the second chapter refers to the performance of cryptocurrencies in the market, where there is a description of all the important elements needed to understand, first hand, the delicate points that integrate all this operations; third chapter includes the national legal system and international regulations associated with cryptocurrencies and their management and control, with the purpose of identifying those practices that are implemented in other countries and suitable with the colombian legal system; in chapter four, the main crimes that are committed in the present are exposed; last, the particularities of the Anti-Money Laundering and Counter Terrorism Financing Risk Management System are explored, and finally, there is an explanation of the ideas that must be taken into account when creating a regulatory framework to regulate and control the transaccions and the management of cryptocurrencies, and prevents their use in the commission of crimes. As a result of the above, and in the development of this topic, we finally present a set of big conclusions and recommendations that can be used as a guide for the substantial transformation of this topic that is becoming a problematic subject in terms of economic, social, cultural, and especially legal order, in reason of the interest that we are involved in based on our legal knowledge and formation. In the dynamic that is corresponded to degree works, investigative projects and development plans, the present work represents a preamble of interdisciplinary nature to the boarding of this topic with such a strong context in the society nowadays and geopolitics; given that it is now a reality and a problem of the cosmovision that we are merged in, with special attention of the legal frame that we are professionally demarcated in.

    Impacto de Google trends y Twitter en la capitalización de mercado de bitcoin

    Bitcoin is a decentralized currency supported by a blockchain system behind its issuance, so it transmits security regarding its value, since it cannot be simply duplicated or falsified. However, given that the volumes of transactions are high and quite variable, it is necessary to study their speculative nature, since studying the influence of some media factors allows us to observe how this type of less regulated asset can be the target of speculation and manipulation. through media such as Twitter and Google. In this study, we use the VAR model to analyze Bitcoin time series, its popularity, and some features. With the purpose of identifying if there is any correlation between fame in social networks and interest in Bitcoin within the Google search engine and the capitalization of this asset in the market. The results show that the influence of Google search interest and Twitter popularity does not have a large effect on Bitcoin's market capitalization.

    Implicaciones de la utilización de criptoactivos como moneda de curso legal y regulación en la República de Colombia

    This research seeks to study the nature of crypto-assets, in order to determine the implications of the use of digital currencies described as legal tender, and specifically, to review the regulation in Colombia on the subject. In order to achieve the purpose of this research, the methodology of comparative law study will be applied, in which the colombian legal system will be contrasted with the legal system of different nations in which the use of Cryptocurrencies has already been implemented, despite having high risks that still must be mitigated. The implementation of Cryptocurrencies brings numerous benefits for nations and citizens who wish to interact with the decentralized financial system, and it is important to understand how the implementation of Cryptocurrencies as legal tender (being a secondary currency) can generate advances in the economy of the respective nation which will be enunciated in this study.

    Modelos de predicción estocástica para bitcoin : una evaluación de métodos y desempeño

    This research focuses on forecasting Bitcoin (BTC) prices using statistical models, including LSTM, GRU, SVR, decision trees, Random Forest, and XGBoost. We evaluate their performance in terms of R2, RSME, MAPE, Lin Concordance Coefficient (CCC), and Explained Variance Score—metrics selected for their ability to assess regression models. We utilized BTC closing price data from 2014 to 2023, subjected to preprocessing involving cleaning, optimization, and data engineering. The models, initially unoptimized, were enhanced through hyperparameter tuning and specialized statistical techniques such as cross-validation, L1-L2 regularization, Bayesian and genetic optimization. The results highlight XGBoost as the optimal model with the incorporation of iterative hyperparameter tuning, Bayesian optimization, and nested cross-validation. It achieved outstanding values in all evaluated metrics: RSME of USD 30.45, MAPE of 0.09%, R-squared of 1.0, Lin Concordance Coefficient, and Explained Variance Score of 1.0 in each case.

    Niveles óptimos de trading para criptomonedas – Simulación Monte Carlo para bitcoin

    This study aims to analyze the use of statistical tools such as Monte Carlo simulation and Geometric Brownian Motion modeling (GBM), to figure out optimal levels, trends, and success probability in the closing prices of the cryptocurrency known as Bitcoin. This study is backed on current literature about the GBM applied on time-series data of Bitcoin daily closing price in an 8-year frame. In addition to this, a clear context is given on how does Bitcoin and its backing technology Blockchain work. Moreover, a simulation with 10.000 iterations is performed, using a stochastic function of GBM, which is based on historical data of Bitcoin prices from the last 8 years. After this, a forecast is performed to get the bitcoin daily yield and a range of maximum and minimum prices within the next 30 days is done, so the model can retrieve as an output a given likelihood of success.

    Regulación de criptoactivos en Colombia en el ámbito de lavado de activos

    At present the financial market presents a transformation process where various innovations have been generated. One of these is the introduction of cryptocurrencies or virtual currencies, whose pioneer was the creation of Bitcoin, which progressively unleashed the development of different cryptocurrencies, as a phenomenon that affects a country not only in the economic but also legal sphere, and that may have international significance due to the characteristics of these cryptocurrencies such as decentralization, the speed of their transactions, anonymity, among others. In the legal field, cryptocurrencies have generated debate at the level of criminal science since their particular nature has generated new modalities for the commission of some crimes, specifically having a greater impact on money laundering. In Colombia, the absence of an appropriate regulation for this type of virtual currencies has impacted on the significant increase in the crime of money laundering, which represents the object of this study that seeks not only to develop the current problem in reference to the issue but also formulate some possible solutions.
