This led to the identification that a significant percentage of the cases handled by civil judges are executive processes. Subsequently, some judgments from other jurisdictions will be analyzed, which have given varied arguments as to whether it is possible to consider life as a damage, and the consequent compensation for damages arising from defective conception and contraception procedures. Finally, the current applicable criteria of medical civil liability -contractual- in Colombia will be identified, which will allow an eventual declaration of civil liability.
