Ítem Mandatory Standard Bidding Documents: Suppression of Discretionary Power to Determine Procurement Specifications?(UNIV EXTERNADO COLOMBIA, 2020-07-01) C. DIAZ DIEZ; C. DIAZ DIEZArticle 4 of Law 1882 of 2018 established that the national government must adopt mandatory tender specifications for certain contractual selection procedures. It also authorized the government to create and extend the obligatory nature of said documents to other selection modalities. Based on this provision and the regulations issued by the national government, the Public Procurement Agency (Colombia Compra Eficiente, ccE) is able to implement mandatory bidding specifications for agencies subject to the General Public Procurement Act. Given the regulatory powers of ca, this paper seeks to determine whether the discretion of contracting agencies for determining procurement specifications has been suppressed.Ítem Meanings of the Administrative Act in the Constitutional Court Jurisprudence(Universidad del Rosario, 2019-07-01) C. DIAZ DIEZThis paper analyzes the meanings the Constitutional Court has assigned to the expression ``administrative act'', contained -both in its singular and plural forms- in several normative statements of the 1991 Political Constitution, with the purpose of concluding if that Corporation, in the exercise of its role as guardian of the Constitutions integrity and supremacy, has built a uniform definition of administrative act or if, on the contrary, it has used diverse and even contradictory notions. Likewise, the paper asks and offers an answer to if the existence of an administrative act's correct definition can be extracted from the Constitution or if defining it, is an activity conferred to the Congress of the Republic, the National Government, the Constitutional Court or the Council of State, which enjoy of configuring freedom for building that concept.
