However, the adoption of new legislation on collective labor law cannot overlook the current problems that it is currently facing, thanks to what has been called abuse of the right to union association. In this sense, it is essential that if a new form of bargaining is promoted, it does not imply that the problems that bargaining already suffers are transferred to the company level, much less that they are maximized. This article will analyze bargaining at a higher level than the company level, its background and how it works in other countries. In turn, some proposals will be put forward to ensure that if the executive's interest in promoting bargaining at a higher level is maintained, the current serious problems of company-level bargaining will not be replicated.Ítem Fallos de la Dirección Nacional de Derechos de Autor y sus subreglas(Universidad EAFIT, 2023) Rodríguez Bernal, Luis Fernando de Jesús; Rendón Vera, José SantiagoThe purpose of this paper is to identify the sub-rules set by the DNDA in its rulings, to determine the existence of an infringement of copyright and related rights and to verify the concretion of the principle of legal certainty in its decisions for infringement of copyright and related rights in relation to artistic, scientific and literary works, for which the study of its pronouncements will be addressed, reinforcing this way, the recognition of alternative instances to the ordinary.Ítem Transformaciones del sistema de elección de los contralores en Colombia a partir de 1991, a la luz del principio democrático y el principio del mérito(Universidad EAFIT, 2023) Alzate Bolaños, Daniela; Sánchez Daniels, Catalina del PilarThe process of electing officials is an essential part of guaranteeing the legitimacy of the democratic system. This thesis contains three chapters: the first one develops the phylogenesis of institutions, such as the principle of publicity, rule of law, right of access to public information, information secrecy and democracy. The second focuses on reviewing the justification and criticism of the reservation of defense and national security information in projection of the national interest. The third one proposes an examination of the reservation of public information on defense and national security from the perspective of constitutional jurisprudence. Thus, it is necessary to make a judgment and analysis of the reservation of information, which must start from a study of the exercise of the competence to restrict the information, in order to subsequently determine how valid are the reasons and justifications to restrict the information in a rule of law that should be characterized as democratic, and not only for invoking national interests of survival.Ítem La responsabilidad civil de las entidades financieras derivada de la terminación unilateral de los contratos bancarios a las empresas del sector minero(Universidad EAFIT, 2023) Pérez Henao, Julián Mauricio; Baena Aramburo, FelisaÍtem Inhabilidades electorales para cargos de elección popular(Universidad EAFIT, 2023) Saldarriaga Gutiérrez, Samuel; Gómez Velásquez, AlejandroThis research project aims to make a contribution from legal dogmatics regarding the concept of electoral disqualifications in Colombia. To achieve this, it was necessary to investigate the history and theoretical framework of disqualifications and political rights. It is crucial to understand that these types of rights have different limitations on their exercise. For example, legal concepts like disqualifications condition and impose restrictions on those who seek to be elected by popular vote. Within this context, the fundamental principles accompanying the democratic rule of law were explained, such as the separation of powers, the principle of legality, and the democratic principle. These principles are essential to ensure the imposition of limits on power, the stability of political rights, and the establishment of electoral disqualifications. Additionally, this text contains an analysis of the purpose of disqualifications and the need for their existence to ensure the stability of the State, the prevalence of the general interest, and the requirement that individuals occupying positions of popular election be morally accepted and possess high standards of suitability and integrity for the exercise of public office. Furthermore, this research project presents arguments regarding the way in which disqualifications are prescribed in Colombian territory, explaining each electoral disqualification cause, both common and specific, as prescribed in the Political Constitution and the different laws containing disqualifications for those aspiring to be mayors, governors, councilors, deputies, and congressmen. Finally, to complement the research and gain a clearer understanding of how disqualifications are structured in Colombia, it was necessary to study the powers of judicial authorities to protect political rights through procedures such as loss of investiture or electoral nullity. In this context, additional arguments were presented regarding the powers of administrative authorities to restrict political rights, as these have been heavily criticized for not respecting the mandates of international content from the American Convention on Human Rights and decisions of the Inter-American Court of Human Rights.Ítem ¿En las pensiones reconocidas o reliquidadas por el Consejo de Estado a los servidores públicos beneficiarios del régimen de transición antes de la Sentencia 00143 de 2018, prima su precedente jurisprudencial frente a la cosa juzgada o es posible, modificar tales decisiones en virtud del recurso extraordinario de revisión, según la tesis de la Corte Constitucional?(Universidad Eafit, 2023) Campuzano Betancurt, Sara Valentina; Bedoya Diaz, Hugo AlexanderÍtem La responsabilidad penal de los terceros civiles en el contexto del conflicto armado colombiano de cara a la Constitución Política de 1991(Universidad EAFIT, 2023) Manco Pineda, Edier Esteban; Montoya Brand, Mario Alberto; Gómez Velásquez, AlejandroÍtem Las cesiones urbanísticas obligatorias : un llamado a la creación, transformación, y recuperación del espacio público en Medellín(Universidad EAFIT, 2023) Pérez López, Maria Ximena; Restrepo Izasa, DiegoThis research paper conducts an analysis of the relation that exists between obligatory urban cessions incorporated within Medellin’s Territorial Distribution Plans (POT in Spanish) from 2006 and 2014 with the creation and disclosure of norms that would generate urbanistic initiatives for the transformation, creation, and recuperation of public spaces in the city. All of this with the aim of determining if the programs and/or public policies on public space that are included in the current Accords of Medellín have allowed the enjoyment of the “right to the city”.Ítem El restablecimiento del equilibrio económico en los contratos de entidades públicas con régimen exceptuado de contratación en Colombia(Universidad EAFIT, 2023) Restrepo Ramírez, Juan Diego; Díaz Díez, Cristian AndrésThe binary conception of contractual regimes in Colombia —understood as the application of the private regime by some state entities and the General Statute of Public Administration Contracting (Law 80 of 1993) by others has generated practical difficulties in its implementation, due to the state nature of the entities that apply the private regime, since it does not regulate all the obligations or duties that state entities must meet or its application could be incompatible with the public purposes pursued with state contracting. One of these institutions corresponds to the economic balance of the contract, which is one of the problems widely discussed in court and, therefore, of great illustrative relevance to demonstrate the complexity of the duality of contractual regimes in Colombia. Given these difficulties, it is important to identify how the economic balance of services is restored in contracts concluded by entities with an excepted regimeÍtem La intrincada estructura de la organización territorial colombiana : una mirada al diseño jurídico territorial(Universidad EAFIT, 2023) Martínez Cano, Jose Eliécer; Montoya Brand, Mario Alberto; Gómez Velásquez, AlejandroÍtem Justicia en internet, análisis de caso : el "tribunal supremo" de Facebook(Universidad EAFIT, 2022) Arias Aristizábal, Diana Carolina; Toro Valencia, José AlbertoÍtem Vulneración del derecho fundamental a la vivienda digna en el contrato de leasing habitacional(2022) Puerta González, Lady Juliette; Baena Cárdenas, Luis GonzaloThis article is the result of an academic investigation that has three relevant legal approaches in Colombia. The first analyzes the intervention of the Social State of Law to guarantee the fundamental right to decent housing, the second develops an approach to the fundamental right to decent housing and finally, the third identifies some current challenges in the housing leasing contract for the materialization of the right to decent housing.
