Este anteproyecto de monografía examina los desafíos jurídicos y vacíos normativos que surgen al intentar proteger creaciones producidas por sistemas de IA, dentro del marco legal colombiano y en comparación con desarrollos internacionales. Se identifica el problema central: la legislación vigente exige un autor humano para reconocer derechos de autor, dejando en la incertidumbre las obras creadas autónomamente por máquinas. La investigación propone analizar en profundidad cómo las nociones tradicionales de autoría y originalidad se ven puestas a prueba por la IA, evalúa casos recientes y posturas doctrinales, y explora posibles soluciones legales. El objetivo general es aportar claridad jurídica y recomendaciones que permitan equilibrar la protección de los creadores con el fomento a la innovación, rellenando lagunas legales en la propiedad intelectual frente a la inteligencia artificial.The recent rise of artificial intelligence-generated works raises fundamental questions in copyright law. This monograph project examines the legal challenges and gaps encountered when protecting creations produced by AI systems, focusing on the Colombian legal framework while drawing comparisons with international developments. The core issue identified is that current law requires a human author to recognize copyright, leaving works autonomously created by machines in a grey zone. The research aims to analyze in depth how traditional notions of authorship and originality are tested by AI-generated content, reviewing recent cases and doctrinal viewpoints, and exploring possible legal solutions.
