Toro Valencia, José Alberto2023-02-212022http://hdl.handle.net/10784/32166Este trabajo aborda el recorrido histórico de la protesta social en Colombia y advierte que, a la par de su incremento también se ha intensificado la represión y criminalización a raíz del tratamiento otorgado por parte de las altas esferas del Gobierno Nacional como estrategia de contención y dilación de la protesta. Más allá de eso, se cuestiona por los riesgos implícitos en la regulación legal de la protesta de cara a su carácter disruptivo y la insuficiencia del derecho para ocuparse de este fenómeno. Además se indaga por la actuación del gobierno de Iván Duque durante las protestas del 2019 y 2021 y la observancia de los estándares internacionales.This work addresses the historical course of social protest in Colombia and warns that that it is increasing alongside the repressive measures and criminalization. It comes in the wake of the treatment accorded by the highest levels of Government as a containment and delaying strategy. Above and beyond that, it is questioned the risks, implicit in the legal regulation of the protests that have deprived them of their disruptive character and the lack of sufficiency of the legal system to deal with this phenomenon.
