Puyo Velásquez, Daniel Mateo2025-05-302025https://hdl.handle.net/10784/35888En respuesta a la creciente relevancia del arbitraje como mecanismo alternativo de resolución de conflictos en el ámbito jurídico nacional y global, esta investigación tiene como objetivo analizar la regulación del arbitraje en Colombia, específicamente bajo el Estatuto Arbitral (Ley 1563 de 2012) y el Proyecto de Ley 009 de 2021, y compararla con la normativa vigente en materia de arbitraje nacional e internacional en las principales jurisdicciones en esta materia alrededor del mundo y los reglamentos de los principales centros de arbitraje. A través de un estudio comparativo, se busca determinar si las figuras actualmente previstas en nuestro sistema jurídico y las reformas legislativas propuestas en Colombia son adecuadas para atender el creciente interés social y económico en el arbitraje y si ofrecen las mismas garantías de accesibilidad, eficiencia, celeridad, confiabilidad y especialización que los sistemas de arbitraje más avanzados a nivel mundial.In response to the growing relevance of arbitration as an alternative dispute resolution mechanism in both national and global legal contexts, this research aims to analyze the regulation of arbitration in Colombia, specifically under the Arbitration Statute (Law 1563 of 2012) and Bill 009 of 2021, and compare it with the current regulations on national and international arbitration in the world's leading jurisdictions in this field and the regulations of the main arbitration centres.
