López López, Tatiana2026-08-132026-05-26https://hdl.handle.net/10784/38216Esta monografía analiza la gestación subrogada desde sus diferentes perspectivas y problemáticas con relación a la dignidad humana en un contexto jurídico y ético en el marco del derecho contractual. La dignidad humana es un principio fundamental consagrado en la Constitución colombiana que exige el respeto a los derechos fundamentales de todos los sujetos involucrados en el proceso de gestación subrogada, en donde se incluyen la mujer gestante, los progenitores intencionales y el/los nasciturus. El objetivo principal de esta investigación es analizar las diferentes perspectivas que hay en Colombia sobre la gestación subrogada, incluyendo también cómo la dignidad humana y la autonomía de la voluntad están implicados en este proceso y el cómo la falta de regulación puede vulnerar los derechos de las partes y, sobre todo, los derechos de la madre gestante y el niño por nacer. Esta investigación argumenta que la protección de la dignidad humana implica garantizar que la gestación subrogada se realice de manera ética, evitando la explotación y asegurando la protección de los derechos de todas las partes. Desde la parte jurídica existen vacíos, ya que no está regulado en Colombia y en otros países. En esa medida, se toma como base la Sentencia T-968 de 2009, donde la Corte Constitucional define por primera vez en Colombia la gestación subrogada. Sin embargo, la jurisprudencia se queda corta en proteger la autonomía y dignidad de la mujer gestante, lo que conlleva a su análisis desde una perspectiva contractual. A su vez, desde una perspectiva jurídico-bioética, la dignidad humana se concibe 4 como un principio fundamental que exige el respeto a la autonomía, la integridad y los derechos inherentes de cada persona, especialmente en contextos donde intervienen decisiones reproductivas. Esta concepción orienta la interpretación y aplicación de las normas, garantizando que el marco jurídico se ajuste a los valores de igualdad, justicia y protección de los derechos fundamentales. El presente escrito sostiene que la falta de regulación de la gestación subrogada en Colombia podría vulnerar la protección de los derechos del niño que está por nacer, en términos de determinación de la filiación y protección de los derechos del nasciturus a través de la gestación subrogada. Por lo tanto, es fundamental garantizar la protección de los derechos del niño concebido a través de este proceso, así como considerar la autonomía y la dignidad de la mujer gestante, evitando cualquier forma de explotación.This monograph analyzes surrogacy from its different perspectives and challenges in relation to human dignity within a legal and ethical context framed by contract law. Human dignity is a fundamental principle enshrined in the Colombian Constitution that demands respect for the fundamental rights of all subjects involved in the surrogacy process, which include the gestational mother, the intended parents, and the nasciturus 5 (the unborn child/children). The main objective of this research is to analyze the different perspectives on surrogacy in Colombia, including how human dignity and autonomy of the will are implicated in this process, and how the lack of regulation may violate the rights of the parties, especially the rights of the gestational mother and the unborn child. This research argues that the protection of human dignity implies ensuring that surrogacy is carried out ethically, avoiding exploitation, and securing the protection of all parties' rights. From a legal perspective, there are gaps since it is not regulated in Colombia and other countries. To this extent, Judgment T-968 of 2009 is taken as a basis, where the Constitutional Court first defined surrogacy in Colombia. However, the jurisprudence falls short of protecting the autonomy and dignity of the gestational mother, which leads to its analysis from a contractual perspective. Furthermore, from a juridical-bioethical perspective, human dignity is conceived as a fundamental principle that demands respect for the autonomy, integrity, and inherent rights of every person, especially in contexts involving reproductive decisions. This conception guides the interpretation and application of norms, ensuring that the legal framework aligns with the values of equality, justice, and the protection of fundamental rights. This paper argues that the lack of regulation of surrogacy in Colombia could violate the protection of the rights of the unborn child in terms of determining filiation (legal parentage) and the protection of the nasciturus's rights through surrogacy.
