Vélez Longas, David2022-04-262022http://hdl.handle.net/10784/31184Esta investigación lee el territorio desde los componentes natural, social y urbano, con una mirada transversal desde lo jurídico, encontrando un conflicto normativo que supone ponderación entre los derechos del manglar Punta las Vacas, como ecosistema frágil de vital importancia y los asentamientos informales por parte de los colectivos vulnerables de especial protección constitucional que habitan el manglar en los barrios anfibios Pescador 1 y 2 del Distrito Portuario de Turbo. Es claro que los instrumentos de gestión y planificación urbana deben encontrarse alinea- dos a las normas ambientales como a las realidades fácticas del territorio, lo que nos lleva a plantear una estrategia para generar concordancia de las normas de carácter nacional con las territoriales, entendiendo que, construir infraestructuras significa intervenir en los sis- temas naturales y sociales y se debe cumplir con la legislación, normativas y procedimientos existentes. El resultado es una Ruta de Gestión que se convierte en una guía práctica, que aborda de manera integral, las problemáticas socioculturales y ambientales en asentamientos urbanos informales sobre ecosistemas de especial protección, que permite una intervención equilibrada y armónica entre la naturaleza y la comunidad.This research reads the territory from the natural, social and urban components, with a trans- versal view from the legal point of view, finding a normative conflict that supposes a weigh- ting between the rights of the Punta las Vacas mangrove, as a fragile ecosystem of vital importance and the informal settlements on the part of the vulnerable groups of special constitutional protection that inhabit the mangroves in the amphibious neighborhoods Pescador 1 and 2 of the Distrito Portuario de Turbo. It is clear that the urban planning and management instruments must be aligned with environmental regulations as well as with the factual realities of the territory, which leads us to propose a strategy to generate concordance of national regulations with territorial ones, understanding that, to build Infrastructure means intervening in natural and social systems and must comply with existing legislation, regulations and procedures.
