Principio de la realidad sobre las formas : análisis y comprensión de sus ámbitos de aplicación en el derecho laboral

Piedrahita Vargas, Camilo2026-04-202025-10-28https://hdl.handle.net/10784/36916El presente trabajo de grado se centra en analizar el principio del derecho laboral, el principio de primacía de la realidad sobre las formas dentro del derecho laboral colombiano, con el propósito de comprender los distintos contextos en los que ha sido aplicado como mecanismos de protección de los trabajadores. Entre estos se destacan los contratos de prestación de servicios, los cargos de dirección, confianza y manejo, así como los pagos constitutivos de salario. De igual manera, se pretende examinar si, a lo largo del desarrollo jurisprudencial que ha tenido este principio, tanto con la Sala Laboral de la Corte Suprema de Justicia como con la Corte Constitucional, es posible aplicarlo en favor del empleador o si, por el contrario, tiene una aplicación exclusiva en beneficio del trabajador.The present thesis focuses on analyzing a fundamental principle of labor law: the principle of the primacy of reality over formal appearances within Colombian labor law, with the purpose of understanding the different contexts in which it has been applied as a mechanism for the protection of workers. Among these contexts, particular attention is given to service contracts, positions of management, trust, and control, as well as salary-constituting payments.
