| dc.description.abstract | This text analyzes the historical, legal and criminal policy conditions that have justified the criminalization of abortion, in order to propose its relative decriminalization in the Colombian Penal Code of 2000. The central argument states that the crime of abortion, despite the fact that seeks to protect the dependent life of the unborn, in some cases it represents an excess of punitive intervention with respect to the constitutional rights of women, since the standards derived from the postulate of ultima ratio are not met to justify their proportionate restriction, effective and preventive. The rights of women and the life of the unborn can be adequately regulated, implementing a system of deadlines in addition to the conditions established by the Constitutional Court that protects them both. It is, without a doubt, a deep and difficult debate that raises serious political-criminal debates. | eng |
| dc.description.abstract | El presente texto analiza las condiciones históricas, jurídicas y de política criminal que han justificado la penalización del aborto, con el fin de plantear su relativa despenalización en el Código Penal colombiano de 2000. El argumento central plantea que el delito de aborto, no obstante que busca proteger la vida dependiente del no nacido, en algunos supuestos representa un exceso de la intervención punitiva respecto a los derechos constitucionales de la mujer, toda vez que no se cumple los estándares que se derivan del postulado de ultima ratio para justificar su restricción proporcionada, eficaz y preventiva. Los derechos de la mujer y la vida del no nacido pueden ser regulados de manera adecuda, implementando un sistema de plazos adicional a las condiciones dispuestas por la Corte Constitucional que los proteja a ambos. Se trata, sin duda, de un debate profundo y dificil que plantea serios debates político-criminales. | spa |
