Resumen
The purpose of this paper is to analyze, in the light of Colombian criminal law, whether it is really necessary to penalize the conducts that infringe copyrights or whether, on the contrary, it is possible to prosecute such conducts by different means given by the different legislative mechanisms in force in other areas of the law. For this purpose, first of all, the main concepts related to the subject matter will be addressed. Then, the assumptions for the criminalization of the conducts from the criminal point of view will be established, and it will be analyzed whether the conducts of copyright infringement are framed within such assumptions; and likewise, the possibility of such infringements being framed in other spheres of law will be reviewed. Finally, it will be determined which legislation applicable to the matter is more convenient and effective to repair the damage caused to the holders of this right by the infringement thereof.

El presente escrito tiene como objetivo analizar, a la luz del derecho penal colombiano, si es realmente necesario criminalizar las conductas que infringen los derechos de autor o si, por el contrario, es posible judicializar las conductas por medio de los diferentes mecanismos legislativos vigentes de otras áreas del derecho. Para esto, en primer lugar, se abordarán los conceptos principales relativos a la materia. Después se establecerán los presupuestos para la criminalización de las conductas desde el punto de vista penal, se analizará si las conductas de violación a los derechos de autor se enmarcan en dichos presupuestos; y, asimismo, se revisará la posibilidad de que dichas infracciones se enmarquen en otras esferas del derecho. Por último, se determinará cuál legislación aplicable a la materia resulta más conveniente y efectiva para reparar el daño causado a los titulares de este derecho por su respectiva violación.
