    This study explores the knowledge that both judges and arbitrators possess regarding the concept of the standard of proof and its application, as well as the lack of understanding of this concept when rendering judgment. While the concept is identified, there are conceptual gaps in its application, resulting in inadequate implementation. Additionally, it was observed that the applied standard sometimes becomes more stringent than what is established for certain processes. Furthermore, it has become evident that applying these standards makes it challenging to establish objective criteria.

    Ethical implications of implementing artificial intelligence in the judicial process are critically examined. This raises questions regarding the ethical consequences of applying artificial intelligence and using related technologies, particularly concerning impartiality, judicial independence, and the requirement to provide reasoning for judicial decisions as a manifestation of the fundamental rights to due process and effective judicial protection.

    The following study was conducted with the objective of evaluating the application of artificial intelligence in the judicial process, aiming to find a tool that could contribute to reducing congestion in the administration of justice. This led to the identification that a significant percentage of the cases handled by civil judges are executive processes. Therefore, it is proposed that some stages of these processes could be developed through artificial intelligence, particularly through the automation of certain phases.

    This paper addresses the different standards of proof that have been traditionally proposed by the doctrine, in addition to the main criticisms that have been made of these systems; the way in which the Inter-American Court of Human Rights has resorted to these criteria in various decisions of massive human rights violations -in view of the fact that its rules of procedure do not expressly embrace this concept-; and finally, the way in which the standard of 'preference of good explanations not defeated' proposed by Rodrigo Coloma, could contribute to the determination of the truth and the reduction of the Court's discretion in the resolution of these cases.
