    In this writing we will seek to reflect on the constitutional breach and dismissals without just cause are one of the scourges that fly the extensive list in terms of infringement of the effective applicability of human rights to be made in the workplace and should be under the full thickness of the law, that is, under the reins of Colombian labor legislation; since in the vastness of existing organizations and, despite the scope in terms of evolution of human talent. The general objective is to perform an analysis of the causes that mobilize a dismissal for just cause that is being argued in a disease (not arising from a work action) in or injuries that generate an inability to work and the process of recovery or healing during the reasonable time of only 180 days. The research methodology is consolidated from two ways: the documentary perspective that favors jurisprudential research, in order to investigate the Colombian legal and legal background (judgments, laws, etc.) regarding the violation of the right to health and under the protection that the State must exercise, in agreement with the organizations and / or companies that assign a person under the employee label to guarantee this inalienable right
