This controversy arises because artificial intelligence has reached a significant level of development and autonomy, enabling the creation of artistic and literary content based on instructions provided by users. However, this new reality poses legal challenges and questions the scope of copyright law. For this reason, the main purpose of this research is to determine whether such creations are protected by copyright. It also seeks to establish who should be recognized as the owner of these rights. For this purpose, different international jurisprudential positions that have established that works assisted by artificial intelligence are susceptible of being protected by copyright were examined. This, taking into account that the courts considered that works assisted by artificial intelligence are the product of human intellect.
