Ítem Desafíos regulatorios de las plataformas digitales de transporte en Colombia en materia laboral : un análisis integral desde las diversas modalidades contractuales(Universidad EAFIT, 2024) Sánchez Cárdenas, María Catalina; Gómez Hernández, Wilmer Alexander; Aguirre Muñoz, Angélica María; Cortés Ramírez, Jairo DanielDespite the undeniable impact of digital transportation platforms in global economies, they are facing a regulatory dilemma due to the regulatory void and absence of clear rules that regulate the relationship between the two sides of the relationship (platform owners and transporters). This situation becomes especially evident in contexts such as the Colombian context, where so far there is no legal framework that specifically regulates such interactions. The reason for the above could be attributed to the fact that the transportation services offered through these platforms seem to escape the traditional categories of employment contract or personal service provision. This presents a considerable challenge when defining the type of relationship existing between the parties involved, a crucial aspect to determine which would be the conditions that guarantee the protection of the rights of these collaborators. In this order of ideas, this study will analyze, first, the panorama of digital transportation platforms in Colombia, that is, their functioning and operation in the Colombian market, as well as the contractual figures that emerge from them or that may be applicable; the positions of the different Government institutions regarding their regulation; the considerations made by international entities and the developments on these platforms in countries such as Spain, the United States and Chile; the presentation of the perception of the people who provide their services through these platforms and, finally, the conclusions resulting from the analysis will be presented, as well as the proposals to solve the problems mentioned.Ítem Fondos obligatorios de pensiones : ¿qué se tiene hoy con el régimen de inversiones y cómo ha evolucionado?(Universidad EAFIT, 2022) Ojeda Ramírez, Mitchell Valeria; Restrepo Ortega, Isabel; Restrepo Giraldo, Andrés MauricioTaking into account that in Colombia there are two types of pension systems, a private one, represented by the individual savings pension funds, and a public one, managed by Colpensiones. This thesis consists of a descriptive and informative work on the former, where the emphasis is placed on how they contribute to the social development of the country, beyond an individualistic conception that may be tied to the benefits of social security. The study starts from its origin, history, and the way it operates nowadays with the changes and legal regulations that have been developed. Therefore, as this thesis finds its cornerstone in the individual savings system, especially in the development of the pension fund investment system, in addition to the benefits that these have brought to the country, a complete analysis of the regulations that cover this system will be presented. On the other hand, each of the regulatory decrees that have given life to the pension investment regime will be observed, starting with Law 100 of 1993, up to the most recent decree that introduced substantial changes in the way private funds make their investments; therefore, obtain returns for the affiliates. In this way, the work will focus on understanding the forms of investment, the different risk profiles, the creation of the multifunds, the evolution of the scheme, and its challenges. Among its multiple causes, both the theory and the empirical evidence suggest that the implementation of some of the social programs of the State create a scenario in which individuals have no incentives to formalize or tend to migrate towards this type of employment relationship. Considering this, this article evaluates the impact of elegibility to the Subsidized Health System (RSS) in the decision to belong to the formal or informal sector of the economy. Using data from the Medellin Quality of Life Survey for 2017, a quasi-experimental impact evaluation model (Discontinuous Regression - RDD) was estimated, from which it could be established that being eligible for RSS has no effect on the decision to participate in the labor market but on the probability of being informal.Ítem Influencia de la trayectoria laboral sobre la probabilidad de obtener la pensión en Colombia(Universidad EAFIT, 2019) Jiménez Jiménez, Sara Isabel; Llano Jaramillo, María; Ospina, Mónica PatriciaThis paper studies the determinant variables of retirement in Colombia, with emphasis those related to the work trajectory of individuals. For this purpose, the data from the Longitudinal Survey of Social Protection made in 2012 are used, and by means of a Probit model the probability of retiring of those individuals eligible to obtain the pension according to the age criterion is estimated. The results of the model show that the age and localization of the first job and the type of remuneration are the characteristics that positively and significantly affect the probability of retiring. The foregoing will be made through the study of the Colombian legislation in force with regards to labor and social security, as well as the legislative bill currently in progress inside the Congress of the Republic, and the concepts of the Labor Ministry that seek to regulate the phenomenon. Additionally, a study of the positions adopted by the International Labor Organization and Organization for Economics Cooperation and Development in this area will be made, followed by a comparative law analysis of the legislation of Spain and Chile, since these countries are pioneers in the evolution of this new alternatives of employment and the protection of those who work on said digital platforms. Throughout the history of labor law and social security in the country, this protection has taken various forms and has been entrusted to different actors. Due to the fact that the protection of this risk has been defined and redefined by each of the regulatory regimes that the legislator has designed, difficulties have arisen in the normative succession during the implementation of each regime. These difficulties have represented obstacles in the recognition of pension rights for Colombians, with the most common cases being those related to the omission of affiliation.
