However, it wasn’t clear if this generated a benefit for the worker, or instead affected their rights, since there can be an evasion in the payment of social benefits and contributions to the Integral Social Security System. The foul of this duty entails the void of the transfer made under such transgression, for the purpose of this one can be done again in due form. Thereby, it is necessary to determine which the legal liability of the different actors Pension System is, from the Pension Funds to the Superintendencia Financiera de Colombia, entity in charge of the supervision of the whole system. In the latter instance, it could be establish a State Liability in case there is an omission by said entity that might be sued for negligence.Ítem Nuevos retos de la legislación colombiana en el sistema de seguridad social integral para los trabajadores digitales(Universidad EAFIT, 2020) Ruiz Tobón, Juanita; Valencia Jiménez, Maria Antonia; Munera Posada, ArmandoThe present degree work aims to approach the current reality of Colombian digital platforms work conditions. The foregoing will be made through the study of the Colombian legislation in force with regards to labor and social security, as well as the legislative bill currently in progress inside the Congress of the Republic, and the concepts of the Labor Ministry that seek to regulate the phenomenon. Additionally, a study of the positions adopted by the International Labor Organization and Organization for Economics Cooperation and Development in this area will be made, followed by a comparative law analysis of the legislation of Spain and Chile, since these countries are pioneers in the evolution of this new alternatives of employment and the protection of those who work on said digital platforms. The previously mentioned analysis will be made in order to determine which is the legal and labor model that best suits the economic and labor requirements of the 21st century, and that at the same time protects the rights of digital workers; since these new employment forms do not implement the formalisms established by the Colombian law and thus ignoring the rights and obligations derived from the employment contract.Ítem Portabilidad de aportes pensionales como mecanismo de garantia alterna a los convenios bilaterales de seguridad social suscritos por Colombia(Universidad Eafit, 2020) Gaudenzi Henao, Marianna; Toro Valencia, Jose AlbertoInternational agreements are a special mechanism of protection of fundamental rights. Colombia has subscribed to several social security bilateral international agreements. These agreements include the protection of the right to social security of migrant workers. The practical enforcement within the framework of these agreements is limited due to migrant workers having contributed to the social security systems of multiple countries. On completion of an individual’s work life, the application of the agreements results in a division of the pension benefit.
