In a first part, the different notions of legitimacy and the convenience of applying the principles of transparency and deliberative democratization to the administrative functions are exposed. In this regard, it will be argued that the principle of transparency constitutes one of the prerequisite for a deliberative conception of democracy and public administration. In a second part, on the light of this theoretical framework, the procedure of previous and public consultation for administrative rulemaking created by article 8.8 of the CPACA and regulated by Decree 270 of 2017 will be analyzed. It will be argued that the existing regulation of this procedure left some gaps that might be filled with some systematic interpretations to guarantee it democratic and deliberative effectiveness. © 2020 Romanian Astronomical Journal. Doing that, the article uses a comparative law, a systematic interpretation and a jurisprudential approach to propose some de lege ferenda and de lege data interpretation on the figure. The thesis aims to hold is that from the existing legal framework it is possible to preach the existence of the figure form certain regulations, but also in a generic form in the light of the provisions of Article 8.8 of cpaca. However, due to the imprecise way the consultation was regulated there will be desirable that the legislative branch develop it in more detail manner in the near future or the Consejo de Estado as the Colombian supreme court on this particular issue defining in a unified way the scope of the public consultation. While this occurs, this paper propose a constitutional interpretation of the institution.Ítem Efectos de la implementación de buenas prácticas de gobierno corporativo en la rentabilidad del sector bancario colombiano(Universidad EAFIT, 2024) Sánchez Núñez, María Isabel; Gaitán Riaño, Sandra Constanza; Téllez Falla, Diego FernandoIn this research work, the effects of the implementation of good corporate governance practices in 24 Colombian banks in the period 2015-2019 were identified using panel econometric models in order to analyze the relationship between these practices and ROE, net interest margin, leverage multiplier and asset turnover. The positive and significant impact on the leverage multiplier and asset turnover was found, as well as the negative relationship between net interest margin and ROE in relation to good corporate governance practices. In addition, the relationship between representative qualitative characteristics of banks, such as origin, stock exchange listing and AAA risk rating, with the implementation of good corporate governance practices was analyzed, and it was found that banks listed on the stock exchange had greater incentives to comply with them.Ítem Impacto de la regulación en la eficiencia asignativa del mercado spot eléctrico colombiano(Universidad EAFIT, 2015-07-15) García, John J.; Arango, Santiago; Ortiz, Andrés F; jgarcia@eafit.edu.co; sarang22@eafit.edu.co; aortizr@eafit.edu.coThis paper uses an ARCH regression model to analyze the effect of several regulatory measures and fundamental factors (the relationship between commercial demand and real availability, El Niño, and water supplies) on the spot price in the Colombian wholesale power market. The results indicate that the regulations established by the Electricity and Gas Regulatory Commission have had a substantial and statistically-significant effect on spot prices. We estimate a long panel model where the time is larger than the number of firms. Our findings show that high market concentration and the possibility of being a pivot agent generate adverse effects on price determination. This will be done by analyzing different variables that characterize this sector, like, historical prices stablished by all operators, all the investments made in network development, market sharing and all the existing regulatory measures. We develop a model for data panels in the period between 2005 and 2011, which makes evident the existing interdependence amongst the different companies when setting rates. Back from 1881 when Joseph Chamberlain promoted a law prohibiting all free competition and confining it to few contracts with the purpose of eliminating the privilege of some individuals. Since that time, the State has tried during the last 20 years to maximize the efficiency of the sector and the benefit of the service to benefit in the process. With that being said, giving total opening to the companies related to the sector, but controlling and regulating the conditions of business and the market with the purpose of introducing the free competition and guaranteeing the efficiency of the lending companies of this service. This leads us to ask is this: ¿What reforms have been made in the electrical sector of the United Kingdom related to the vertical disintegration? ¿Which are the effects that have had these reforms in the electrical sector on integration or vertical disintegration? ¿Which have been the effects of the reforms on the asignative efficiency, that is to say, the effect in the prices of the service? For this purpose, we will begin by describing the creations that are protected by the mechanisms provided by intellectual property in Colombia from the scope of private law. Additionally, we will discuss the protection mechanisms provided by private law to intellectual property rights. Then, we will delimit which are the legal properties that are protected in these cases, to later analyze the crimes against intellectual property in Colombia (sections 270-272 and 306-308 of the Criminal Code), and finally to identify whether or not protection is necessary and, if so what are the shortcomings of the Colombian legal system in this regard.
