It analyzes the concept of gender apartheid as a system of structural discrimination and institutionalized violence against women and other gender identities, comparing it to the racial apartheid and gender persecution regimes, defined in the Rome Statute. Through an interdisciplinary approach that includes international jurisprudence, human rights conventions, critical gender perspectives, and case study analysis, it examines the legal elements necessary to classify it as a crime against humanity. It also addresses the potential impact of such classification on the promotion of gender equality, the eradication of oppressive practices, and access to justice mechanisms and reparations for victims and survivors of gender-based oppression globally.
