Ítem Momentos críticos en los procesos verbales sumarios de familia de regulación de cuota alimentaria(Universidad EAFIT, 2020) Martínez Angarita, Viviana; Zuluaga Jiménez, Karina; Ceballos Velásquez, AlbertoLegal offices have both an academic and social purpose. In Colombia they are regulated by Decree 196 (1971) and by Laws 583 (2000) and 640 (2001). Their services include legal advice, conciliation, representation, administrative actions and interposition of resources, and pedagogy in rights. In order to provide such services they must rely on labor, criminal, public and private law domains. This project aims to provide support to EAFIT University’s legal office and the university’s law undergraduates. It describes the jurisdictional process of knowledge, and the critical moments of the agreement process. It also highlights the challenges that commonly occur during this processes. Thus, this work follows the research questions: 1. What are the critical issues present during the food quota process, specifically during the agreement on the provisional and final food quota? 2. How can the legal office’s failures be prevented by the current system and regulations? 3. Is there an alternative by which legal offices can expedite conflicting parties claims and offer effective solutions through systems and regulations that avert a jurisdictional process? These questions will be solved by analyzing the real problems that have arisen in some cases of EAFIT University’s legal office and conciliation center, as well as the challenges experienced by this institution’s law undergraduates due to the issues related to the jurisdictional process of knowledge. It was possible to identify that most of the obstacles were caused by insufficient requirements when presenting the food obligation claim, plus the subsidiary or legal juridical link, the need for food, the economic capacity of the feeder and the imposition of provisional food. Based on these, several solutions are proposed for the establishment of food quotas in minors and the definition of provisional food, in order to facilitate the process.
